When you sign a lease agreement, you do not intend to break it. However things can happen, Health problems can keep you from work, you can lose your job, or unexpected finances come up. The result is that you cannot pay rent. You may also want to break a lease to get out from underneath a bad landlord. Or to get away from a neighbor. It may not be expected, but there can be times when breaking a lease is necessary.

Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.

Here are six important tips to protect yourself should you face an eviction.

  • Know the laws

Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.

Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

  • Keep records

From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.

It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

  • Consult with an attorney

It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

  • Go to the hearing

You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.

Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

  • Handling an eviction

In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

  • Getting another place

Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.

Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.

Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.

An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.

Desperate single mother of 3 children, need assistance with rent and bills.

Hi, I cannot believe that I am here, basically begging for help.

I am a single mother of 3 beautiful children. I divorced their father 4 years ago, and he has refused to pay his alimony and child support since. I however had gotten myself past the need of his support until I lost my job due to being hospitalized in July . . At that time that happened I was engaged to whom I thought was the love of my life, And had financial support through him until just a few weeks ago. On thanksgiving of this year that man snapped. He beat me black and blue in front of my two oldest children, which obviously resulted in the end of that relationship.. I am trying so hard to make this right for my children. They deserve the world, and I am the only one guaranteed to try and give it to them. I am in the process of opening my own childcare center. Start up has been costly , but I am so far in I don’t want to give it up now. I will make this work!! I was just given no notice of things falling apart, and was not prepared.

the kids and I are currently sitting in a home without electricity. Water will be cut off next and we are facing eviction… all at Christmas time. My heart is broken and I feel as if I have failed my children. I don’t know what else to do but continue to look for part time jobs to fill the gaps, and Pray!!! I’m leaning so hard on my faith, for He has never failed me. I have never had it in me to ask for help, but here I am begging. I cannot los their home, I cannot watch them sit in the dark any longer. Homeless and Hungry at Christmastime/Losing Hope

We are a family of 3 – Mom, adult daughter, 3 year-old grandson in Vancouver Canada. The landlord was granted an order of possession  Primary File Number 91013268x and We were evicted on December 15  at 1 pm. because our November rent was late even though it was paid but past the 10 days. For 2 years we paid regularly but the arbitrator said that doesn’t matter and he sided with the landlord. It makes sense that he doesn’t care but what came next makes me so sad and triples my stress.
Our  friend “movers” bailed the day before and said
I work in the DTES community of Vancouver for a housing agency. You’d think they’ll help, but NOPE. “There’s no housing, sorry can’t help.” “But how are you, can you work extra shifts”. They don’t seem to have any idea that when you’re under the stress of no place to live and have to lug around the clothes and items you need, it’s hard AF.  Friends are disappearing. It’s like we have a rare disease.
We spent our last money on cabs and Ubers, storage, and the cheapest hotel we could find. We are not averse to staying at a shelter, but they’re full. We keep calling every day to different shelters (splitting up is easier to get a shelter space) but it’s not guaranteed. My daughter is looking into sugar daddy sites today. We’re not judgmental, to each their own but that’s not the life she’s looking for.
My daughter went to see a Housing advocate at the women’s center downtown and they’re helping with her a BC Housing application but yesterday she seriously asked my daughter what she’s going to do. WTF
We’ve been searching for housing but its so expensive and we’re out of cash. I work, but I don’t get paid until Friday and I don’t make enough to pay for a hotel room food, and a damage deposit. She’s on assistance and goes to school but doesn’t get her money until Wednesday. Combined it’s not enough because we’re out of time. She’s missing school until we figure something out. I’ve taken holiday days but I’m expected back at work Monday morning.
Christmas is 8 days away.
If it was just the two of us we could suffer on the street, but not with the boy.
Any money we receive will go to food and the boys’ needs (his name is Ezra but he refers to himself in third person, so cute), and temporary shelter so we can lower the intense stress and think properly. Then we will save our cheques and look for a place to rent on January 1 (fingers crossed) unless a BC housing place opens.

Avoid Eviction

In September we lost use of a car of ours.  I DoorDash and not having a car always available to DoorDash is not helpful.  November I was scammed out of $1,350.00 a loan that they kept saying it will come for more money and another excuse why it did not work.  I hoped that it was true but that has left me losing money that we could have gave to our Landlord.  We could not pay $1,000.00 the week of thanksgiving that would have kept them happy.  They filed for Eviction on December 04 and we have Eviction Hearing Monday the 18 and they would like to have us pay $3,427.56 we have hopefully have $1,000.00 by Wednesday but do not know if our Landlord will work with us.  My Stepdad has a job it helps but not enough and my Mom is on disability.

Not such a happy Holiday

Hello, my name is Ryan Ford and I reside in Dallas Texas.  Both my parents passed when I was younger and I am the only child.   Don’t have any family in the area or any that I communicate with on the regular.  Lately really been down in the dumps because life has really been lifing for me.  I lost my great paying job back in august and really haven’t found a steady job since.  Long story short I lost my car due to it being voluntary repossessed the beginning of November which hurt because I was trying to do Uber and DoorDash to try to make money to make.  That came to a stop since I don’t have a car.  Now it seems pretty hard to find any work from home jobs to try to make money and now I’m two months behind on rent and facing eviction.   I feel so defeated right, especially since I don’t have neither of my parents for help me or anywhere to go but possibly a homeless shelter.  and don’t want to end up on the streets.  I came across this platform and thought maybe a blessing will come. Single Mother Hoping for Some Rental Help

I am recently divorced. I have three children under the age of 8 years old. I was recently in a car accident on 10/17/23. I was found not at fault, yet their insurance company has still not paid for any damages. I immediately contacted my employer and requested a leave of absence. Although I had already used the 4-week allotment given, I was denied a leave of absence. My company’s policy only includes a 4-week leave of absence per year. I had used all of this during my divorce for multiple reasons.  The company I work for then requested that I put in my resignation since I was unable to come to work.

 

The vehicle I was in the accident with was totaled and was the only vehicle I had. I tried to get another vehicle, but my credit was ruined because a vehicle I had co-signed on for someone else had gone into default. I did not have any extra money set aside, all of that was used up in my divorce. This left me unable to get another vehicle. I have still not received anything from the person at fault’s insurance company.

 

In the meantime, my bills were accumulating. I have started doing some transcription jobs from home. This allowed me to pay the majority of my bills. Unfortunately, I have gotten behind on my rent. I currently owe $4,000. It’s $2,000 a month, which I know is a lot of money. Colorado is a very expensive state for rent. I am hoping and pleading for anyone who can help to please help. I do not want to be evicted during Christmas. I will be fine on bills for the upcoming months. I just can’t catch up and my apartment complex requires rent to be paid in full. I can’t just pay for one month. I would be eternally grateful to anyone willing to help with this! Thank you for reading my story.

Please help me avoid getting evicted !

Hello, everybody!

I am reposting this. I am currently unemployed because I lost my job back in October. I have run out of money, and I need to find a way to pay my rent and bank loan for December and January because it’s impossible for me to make money during this period as a freelancer or even to find a job, where I’m from. I have a client with whom I will resume work starting in February but until then I won’t be able to afford my rent and bank loan.

In need of a real Christmas Miracle

First and foremost, I would like to thank anyone who is able to help. 

  I am finding myself in a bad situation. I had an eviction filed. My landlord put down I owed for July and August rent. I only owed for August at that time. When I went to court, I did not have my proof that I had paid for July, so we had to redo a new court date. Well in the process the court had me pay for August rent I will sit across the hallway to get some assistance from some legal advocates who signed me up to get help and I was told that I didn’t need to contact the landlord because they would be taking care of everything. I did get notification from them two weeks later that they would be paying for my rent for six months so I wouldn’t have to worry about it until the end of January. However, I just got an e-mail two days ago saying that the rent could not be paid, and I found out that my landlord will not accept payment from any outside sources. She wants me to pay the rent paid directly to her. She does not want to deal with any foundations or anything like that. Which puts me in a very hard place. My husband is completely disabled I myself have bad knees. I am bone on bone. I lost two of my three jobs taking care of my husband. In the past two years he has been hospitalized six times. The last two times I almost lost him. He is back, he’s doing much better, but he is unable to stand for more than maybe 5 to 10 minutes. He’s not very stable he needs a wheelchair or scooter. He has medical equipment and medical care I am taking care of for him.  I am his caretaker and the bread winner which makes it very hard on me especially with him in and out of the hospital.  I am down to one job this job does not pay very well but it allows me time to take care of my husband. I just get back on my feet and pay the back rent that I owe and move I need a flat. We are in a two-story townhome and just found out she will be going up on the rent. I cannot afford what she is going up to. I do have to pay her the back rent in order to rent somewhere else, because with an eviction unpaid no one would rent to me. I only have six days to get this done well now 5. I’m so sorry for this short notice, but I’m just finding all of this out and she will not talk to me. She wants to see me in court. I do believe she wants me to move out because of my husband’s health issues. I need to move anyway, because I need a flat. The townhome doesn’t work for us anymore with both of us having problems going up and down the stairs. If anyone is willing to help right now, my situation is at the point to where I am $9000 in debt and I have no idea of how this is going to work out. I just found out about this site from a friend who sent it to me. She told me to try it. Unfortunately, I only have basically five days to come up with this and I can’t see it happening. But I am willing to try anything at this point. I need a Christmas miracle. I just need some help getting on my feet and I can take care of it from there and I have promised myself and God that I would never let this happen again. Don’t want to lose my 4 legged best friend along with everything I own

Hello, hopefully this letter finds you in a better place in your life than I am in mine.  My situation starts with moving into my new apartment… (well a temporary one, as twice, in a 3 week period, management gave my reserved apartment to someone else). So they stuck me in an apartment full of multiple health code violations, gunshots every night from the parking lot, and over half of the appliances were nonfunctional.

I tried repeatedly to get ahold of management because I couldn’t get my car to register on the towing company ‘s website.  I sent over 76 emails trying to get information, help, or a resolution to something, and was ignored 80% of the time.

After almost a month in the disgusting temporary unit, they finally had my permanent unit ready.

A week after moving myself over there, my car was towed on a Friday night and I discovered it when coming out of my apartment to leave for work.  I had to call a Lyft to get to work.  It cost me $300 to get my car out that afternoon, plus Uber fees to work and to the towing lot.

I called the towing company on my way home to make sure they had all documentation and paperwork they needed to not tow my car from in front of my apartment again, and kept the lady on the phone to make sure she had all my documentation.

3 weeks later they towed my car again saying they had emailed me 2 more documents a week later that I didn’t respond too, so they towed my car again, though this time, they pierced my gas tank while loading my car.

So I had to pay another $300 to get my car out and then $1600+ to buy a new gas tank to have installed.

When I confronted them and asked about reimbursement, they just said claim denied.  I was again unable to get any correspondence from management over either incident, and found out from some current and former residents that the towing company repeatedly does the same thing when people first move in, and probably has a kickback deal with office management.  Fast forward a month, and I found out I have a terminal illness, but can’t really stop working because I don’t have any savings as I went through most of it when they closed my place of business during Covid.

I applied to several places for rental assistance, and though most organizations are out of funding, one said they could help me and so I got started with the forms and paperwork.

I had to have certain documents from my landlord, and again, it was almost impossible to get what I needed.  I was eventually dropped by the organization which was going to help, because even they couldn’t get the property managers to respond to repeated emails and phone calls needing documentation.

I tried starting the Verification process over last week, because they fired the old apartment managers and got all new ones, but still couldn’t get the new ones to answer most requests, and now am being evicted.  An eviction will make it almost impossible to be able to rent somewhere else.  I guess I could live in my car for awhile, but I can’t leave my 4 year old puppy in it while I continue to try and work, so I’m kinda at a loss with very few options.  I’m $4500 behind in my rent and being evicted tomorrow or Tuesday unless I can pay the landlord and get it cancelled.

I know there is a lot to this particular request, but it’s kinda been an avalanche for all these things to happen to me seemingly at once.

Any help would be greatly appreciated, though I may have run out of time all together.  Whatever I can collect I plan to give to my apartments so I at least won’t have as large of a debt to try and pay off.

I HAVE NO ONE. ALL MY FAMILY’S DEAD. PLEASE HELP ME GET BACK ON TRACK

I am 37 ,my name is Eva Maria Acosta. I have had five children the last two being twins. One passing away only 8 month a week and day old. And the second twin passing 23 months old 2 days before Christmas. Needless to stay is what started this whole domino effect of family death. Following my twins two of my sisters passed tragically and then one of my brothers was murdered three of my uncles died MY GRANDMOTHER AND GRANDFATHER MY TWO UNCLES AND THEIR WIVES ALSO PASSED my youngest brother was killed in a car accident my daddy died of a heart attack and just this year my mommy died complications due to MS. My mother who’s I was dedicated to gave up my home which had a few payments left gave up my job to come back to North Carolina and now I’m left left me in serious debt. I could ask for hundreds of thousands of dollars but really and truly I’m just here for 3 thing to help pay my mother’s back taxes which was $7,000 I’ve paid it down to $1,500 or if I don’t get it they are going to take the land and my remaining living children will have nowhere to go. Also when my mother was diagnosed and they needed me to come back I am 2200 of 10,000 to the plus with my dentist to redo my smile( so I can regain my confidence )due to an ex-boyfriend beating my teeth out and in car accident busting most of the rest out. And if it wasn’t non-refundable I would just take the $2,200 back and pay it on the land but they won’t let me due to the agreement so I figured I better just go ahead and try to finish getting the $10,000 up so I don’t waste my $2,200 and really the third thing is my car needs $300 of work in order for it to pass inspection so we can have a vehicle to be able to work and go to school we live in the county so there is no bus line or public transportation of any short. I am a hard worker and a Big hearted person and if I get blessed with a little bit of help to get back on my feet and to get my life back I will 100% pay it forward to the to anyone I see and need. Urgent Assistance Needed to Prevent Eviction and Save My Parents Home

Dear Community,

I am reaching out in a time of great need for my family. I am the eldest of three sons, and for the past seven years, my younger brother and I have been the main support for our retired parents. Unfortunately, their modest income from social security isn’t enough to cover our basic living expenses, including rent and bills.

I’m Usually Lending But Now It”s My Eviction Pending….

Hi, I am an artist and musician from Seattle Washington and I am asking for some help financially because I really need it. I am usually the one lending money to my friends or helping people with a place to live or helping them find work but I am the one this time who needs the help. Three years ago my wife took her own life due to clinical depression and substance abuse. She did it right in the middle of lockdown from Covid and right in front of me. It was traumatizing to say the least and it also led to me having to leave our house we lived in and the business that we ran out of it. I had just finished building a recording studio in the downstairs of the house that was fully functional music studio that had been outfitted with cameras and was going to be part of a YouTube channel we were starting but after my wife passed on I could no longer stay in the house, it was just too much and too hard to be there after that. My wife’s family are very wealthy but I am not and when I left the house and moved on with what was left of my life, I was moving on without the financial stability that I had when my wife was still here. It was fine though, I had a small savings and was determined to not let this terrible thing that happened completely devastate me although it did for a long time. I lived out of hotel rooms for a period in between leaving our house and finding a new place for a few months but I eventually found an apartment and I moved in and started my life over again. I had decided to go back to school so I started attending college again in a whole new field. I had an interest in aviation so I am learning to become an Aircraft mechanic. While I was going to school I used what savings I had to pay rent but it eventually ran out but there was rental assistance here in Seattle for those who needed the help and I signed up because attending school full time and trying to come up with rent and food and all the other expenses was really overwhelming. Recently I was up for the assistance to come in for me because it was my turn in the lottery or however they disperse the funding but a week before I was to get my back rent paid for the government pulled the funding and now I owe about 11 months in back rent and have been handed my eviction papers. On top of this some of the criminal element that hang around our neighborhood at night decided to break the windows in my car to try and see what they could steal out of it and now I need the windows repaired which is going to cost a couple thousand dollars more to fix on top of the thousands in back rent. I am trying to get enough money together to get in to a new apartment since I am pretty sure that with the eviction preceding they will not want me to pay the back rent, they will just want me to leave but I think I might have a good outcome because the management in this building have been very unhelpful with trying to find a way to resolve the situation. They would not let me pay the back rent in payments when I offered and they were also supposed to offer me lower rent with the Covid moretoreum but they did not. I am hoping that I can raise enough money to pay for the damage to my vehicle and have enough to get a new place to live and be able to pay for moving costs and everything that comes with moving. I am close to finishing my program at college and I hope to open my studio again in the next couple years once I am back on my feet. Please help me in any way you can, it will be greatly appreciated and I will pay it forward in the future when I am in a place where I can help others again. Thank you!

My name is Mehalet Workneh, and I hail from the beautiful region of East Africa. I wish to share with you a glimpse of my life journey, a journey that has been marked by both trials and triumphs.

 

I come from a large and close-knit family, consisting of seven siblings. Remarkably, my parents have been married for a remarkable 51 years. My mother’s story is particularly poignant, as she entered into a marriage at the tender age of 14 through an arranged marriage. By the age of 17, she welcomed her first child into the world. Today, my mother is a resilient 65-year-old, while my father, at 87, remains a pillar of strength in our family. Their enduring love and happiness together serve as an enduring source of inspiration.

 

The genesis of my journey brought me from East Africa to a faraway land, driven by a burning desire to acquire a high school and college education, and in turn, provide support to my beloved family. My quest commenced during my 10th grade when I secured my first part-time job. With adulthood came a steadfast commitment to employment, as I worked diligently to ensure my family’s well-being. My dedication eventually led me to George Mason University, where I earned my bachelor’s degree in Health System Management. However, the dream I had envisaged did not come to fruition, leaving me disheartened. Instead of a triumphant realization, it felt more like a daunting nightmare.

 

In the face of adversity, I found myself and my family residing in low-income housing. Both of my parents grappled with underlying health conditions, requiring them to rely heavily on medications. Fifteen years ago, my father’s life hung in the balance when he suffered a heart attack that necessitated open-heart bypass surgery. The news was devastating, yet we clung to our faith, and by some miracle, he emerged from the ordeal, leaving us profoundly grateful for each day we share with him.

 

The struggle to secure a job within my field of study pushed me to the edge, prompting me to take up two full-time jobs that offered minimum wage. Additionally, I juggled two to three side gigs during my limited spare time. This relentless work schedule enabled me to break free from my parents’ house and secure my own apartment while continuing to support my family financially. Despite these strides, the demands of a 90 to 101-hour workweek left little time for family and self.

 

In 2018, after enduring approximately 34 different jobs, I finally landed a more stable position as a server in a hotel lobby. This role exposed me to an array of prominent figures, including politicians, celebrities, business leaders, and tourists. However, this transition came at the cost of mounting stress, pushing me precariously close to a state of depression. The onset of depression, in turn, led to suicidal thoughts. Seeking help from psychiatric professionals became my lifeline, although it depleted my financial resources entirely. I sold everything what i have from my apartment and I moved back to my family apartment till i got better.

 

Depression held me in its grip for three grueling years, and I ultimately lost my job two years ago into this battle. My parents, regrettably, remained unemployed. My father received a mere $808 from his SSI, while my mother couldn’t qualify for any support as she had not been employed. During my treatment, my employer refused to provide short-term leave or disability benefits, and upon losing my job, I was not compensated for my accrued vacation hours. This loss of income left us falling behind on rent and struggling to manage our debts, forcing me to sell my car for much-needed funds.

 

My depression deepened, manifesting as daily despair, emotional withdrawal, alterations in sleep and eating patterns, loss of interest in once-cherished activities, and overwhelming anger, irritability, and fatigue. Panic attacks, breathlessness, and unrelenting anxiety further hindered my ability to work, ultimately leading me to disability. These debilitating symptoms disrupted my daily life, rendering me incapable of even the simplest tasks at home or in a work setting.

 

While I endeavored to regain my physical and mental health, my father’s condition took a dire turn. At 87 years old, he suffered another heart attack, intensifying my emotional turmoil. Medical professionals hesitated to perform surgery due to his age, and during a coronary angiogram, an unforeseen complication damaged his kidneys. Despite the odds, and through the grace of a higher power, my father survived, a testament to the remarkable power of faith and resilience.

 

After three arduous years of grappling with major depression, I found solace in professional mental health treatment that targeted the underlying causes. My journey toward recovery involved delving deep into my faith, dedicating two hours each day to reading the Bible, allowing me to rediscover a sense of peace and well-being as I reconnected with my creator.

 

My aspiration had been to return to school once I saved enough money to pursue a different career. Regrettably, my path has become fraught with overwhelming challenges for both myself and my family. I trust that you now understand the depth of my experiences and the trials I have encountered.
