When you sign a lease agreement, you do not intend to break it. However things can happen, Health problems can keep you from work, you can lose your job, or unexpected finances come up. The result is that you cannot pay rent. You may also want to break a lease to get out from underneath a bad landlord. Or to get away from a neighbor. It may not be expected, but there can be times when breaking a lease is necessary.

Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.

Here are six important tips to protect yourself should you face an eviction.

  • Know the laws

Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.

Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

  • Keep records

From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.

It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

  • Consult with an attorney

It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

  • Go to the hearing

You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.

Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

  • Handling an eviction

In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

  • Getting another place

Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.

Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.

Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.

An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.

Casualty of the writers/actors strike

In May 2023 production shut down on Loot, the production my husband had been working on, due to the writer’s strike. He was part of the crew. Up until then I had been a stay at home. I was hopeful that when our youngest entered kindergarten, of the same year, that I would have the time to re-enter the workforce, but it had not worked out that way because he spent every other week at home sick due to his asthma. But because my husband was working, we thought everything would be ok regardless. We had never been comfortable. Having a single income in LA had always difficult. Actually, we constantly struggled even before the strike. Child care for three small children was never something we could afford given the extremely long and sporadic hours he worked. We got through it, but we always struggled.

When the strike came he reassured me that this would be good for all of the crew. That this could change the film business for the better. The first blow was unemployment. He actually had to go to unemployment court to prove that he had not falsely claimed unemployment during the film shutdown of 2020. Even though it was national news that the film business was shut down from March-September 2020, CA unemployment still accused my husband of falsely claiming during those months. It took until September 2023 before his case was settled and he could receive the $450/weekly that is the highest unemployment available. That ran out in November.

The five months from may until then were absolutely crippling. We had no savings and lived off borrowed money. Literally thousands of dollars of other people’s money. Every single day we faced homelessness. My husband went into a deep depression. Day after day he could hardly get out of bed. We fought endlessly. I got a part time job, but ended up losing it for taking my children to work with me. I didn’t have many options because my husband was unable to watch them. He was lost in his depression. He became suicidal. It took months before he received a diagnosis of major depressive disorder and finally got medicated.

The film business provided no aid. In order to receive aid from from his union he would have to pay his dues, something we never had the extra money to pay. Regardless, the aid was no more than $1500, barely enough for a one bedroom in LA.

Finally, we were able to borrow money to fix our only car so that my husband could drive uber. That began in late November. Given all of our debt we stopped paying rent altogether. Now, we are facing eviction. I have become a shell of a person, afraid to eat because I don’t want to take away any food from our children. My husband and I can hardly be in the same room.

The strikes ended, but still no calls. When we leave we will be going our separate ways. Our lives, our home, and our family have been completely destroyed. We are losing everything.

I’m not really sure what the strikes accomplished? Perhaps they will make things better somewhere down the line. But can we be the only family effected this way? What happened to the rest of the crew?

I don’t really know how I will survive once we are evicted on March 1st. We have no family in LA. I will somehow have to get our three children to Texas without a car, probably leaving everything we own behind.

Single Mother Facing Eviction

I am seeking help for my children and I so we can avoid being evicted from our home. The last few months have been very difficult with back to back illnesses that prevented me from working and lead to me losing my previous job. I have a new job that I will begin but it would be too late for me to avoid being evicted by time I would start receiving pay. 3 Day Eviction Notice and Emergency Car Repairs

I find myself in a desperate situation. After losing my job, I moved in with my best friend and rented out my home to save money, but my renter stopped paying and destroyed the inside of my unit. I was trying to make repairs to sell it, when the condo association announced a major assessment for a new roof and all new plumbing. This made it impossible to sell as I would have had to pay a great deal to do so.
While living with my best friend, I came home one day to find he had changed the locks on me with no explanation and after a few weeks he killed himself. With no where to go, I moved back into my unit that I could not sell or afford to live in. The foreclosure date was set, but the bank told me the date was changed to a month later, but they went through with the original date and the bank has now foreclosed. I would have declared bankruptcy before the sale, but was unable to do so when the bank reverted to the original date.
I’ve now received a 3 day notice to vacate, with nowhere to go, no family to fall back on, they disowned almost 20 years ago. I will be living out of my car when they come to enforce the notice to vacate. Unfortunately, my car hasn’t been running for the past month and needs a new radiator which I can’t afford. Working as a handyman, I’ve been unable to transport myself or my tools to various jobs without my car. As if things couldn’t get any worse, I’ve now dislocated my shoulder making it near impossible to do any kind of work at the moment. I’m trying to sell all of my belongings over the next three days. Its a truly awful feeling to be asking for money, but I’ve essentially lost everything that matters to me in life and it feels as if I have no options left.
My car repair estimate is $600 and I need $1500 to secure temporary housing. This is only for absolute essentials, and doesn’t even begin to account for all the other medical and credit card debt I’ve incurred over the past few years. My partner and me are becoming risk of eviction 

He is trying to work as many hours but they have been capped by the company he works in. I have struggled with PTSD and depression so I’m working limited hours for years and we are both trying to have a good income. However around a few months ago he lost most of his shifts due to more recruitment and we had no choice but to take out credit card loans. Family are abroad and unable to help but the debts we’re in are very straining and we are now at risk of eviction because of accumulated rent arrears. We are barely surviving.

Losing Hope

IN NEED OF A HOME

Hi, my name is Cece, I am 22 years old, and I am in need of a home. A little back story about my situation is that I have live with my parents currently. for years they have been verbally and emotionally abusing me since I can remember. I was told I could stay with them until I am 24 but I cannot handle being down talked, judge for my life choices and things stolen out of my room while looking for a job (money, my meds, my personal belongings). Desperately in need of a swift rescue,

“My mom once said, ‘If it wasn’t for bad luck, you’d have no luck at all. This phrase has echoed in my life, especially since the birth of my miracle child, whom I was told I’d never have. However, tragedy struck when my son died in a dangerous crib, a fact only acknowledged by the government weeks after his passing and amidst the isolation of COVID-19. Adding to the pain, my best friend, my rock in hard times, died in a car accident.

I struggled to process these events, battling gut- wrenching pain and bouts of near agoraphobia. Therapy became my refuge, helping me manage the overwhelming grief. The loss of my son was compounded by revelations about the crib’s dangers and the company’s negligence. Yet, when I sought legal justice, I was barred by the statute of limitations, deepening my guilt and distress.

Pre-COVID, I was on bed rest during my pregnancy, and then my employer was acquired, leading to my job loss postpartum. As an artist and designer, I invested in starting my own business, but this strained our finances. My husband, an electrician, took a long leave following our son’s death, further impacting our financial situation.

Our plight worsened when a friend, battling addiction, betrayed our trust, leaving us with significant financial losses and a mountain of unpaid toll violations. This situation has left us with a monthly financial burden of approximately $4,000.

We now face two immediate and critical financial deadlines: a storage unit bill of $1,300 due by the 9th, and a power bill of $1,800 due by the 11th. Failure to meet these payments will result in losing my storage unit, holding memories and investments over nine years, and having our power cut off in the winter.

From Sin to Savior &Savior to Success.

Hello my name is Berry Anderson Jr. I’ll turn 48 the 11th of January, a couple days from now.  I’ve been paralyzed from a gun shot wound to the spine in which I’ve been paralyzed from the waist down for 20 years now.  I’ve lived in Houston TX all my life and I’ve never been anywhere really.  I love Houston, but just because I’m in a wheelchair n are somewhat restricted from traveling.  I have 2  stage 4 decubises ulcers.  Bed sores that r showing pelvic bone n I also have osteomyelitis which is bone infection n if not treated it’s fatal. I need to being the hospital right now for long term antibiotics.  If I don’t go get admitted soon, if the infection reaches the bone marrow it’s almost irreversible.  Well I have a 107lbs pit bull ,dalmatian mix n he has my back 110%. I had my own apt. for the very first time for 4 years now. Always been in some type of institution for all those past years. Hospitals,nursing homes,group homes, renting rooms n basically just getting by.  By getting shot at 26, I didn’t realize that I really never had goals hope n dreams. I just realized that about a year ago.  Being in this violent apartment complex I’ve been wanting to move the last 2 years but haven’t had any luck finding something I can afford on $960.00 a month. Eviction notice Please Help

Hello my name is Israel 20m who lives with girlfriend 20f and 2 kids 5f and 8 month M. I need 4000 dollars or me and my family will be kicked out. I know I am vey young with 2 kids and I will admit I have acted irresponsibly with my job placement, I mean starting off things were ok I was just scraping by with rent and utilities while working at dhl but then I took a pay cut working at as a tent installer(people who build big tents) and everything went downhill from there. Money became tighter I had to keep asking my mother and family for help, so I eventually they made a example out of me and fired me for no reason since they were under the assumption I was leaving and going to Amazon which would have been the case if I passed the drug test. I started another job which they delayed from the 14 of Nov to the 28th and missed one day which I called in for and thought nothing of it until, I return the job site and they tell me I’ve been fired, working badge/login pin but since I missed one day it fired me. So everyday on the job center app I am reminded of the money I could be making since their app still has me in the system as working there. I know I’m asking for a lot but I can promise this will never happen again I start a job Jan 4th 18 an hour with 1 bonus for 2 week perfect attendance and will continue to make money again I don’t care what I have to do I just need to leave the hellhole of an apartment which mind you has a serious roach problem which they have not fixed. And it feels like this place only ever gets stuff done around the building when I pay my rent. I’m in dire need and facing homelessness. Setting my pride aside and asking for help.

Hello, my name is Kalitha. I’m currently facing not being able to pay my December rent in full. I have until Jan 5th. My rent is $2,775 and I have $1,356

Also my apartment added on late fees to the total amount. So in total i owe $2949  because of late fees, trash and water that is also included. So on my end I’m short by $1,593.

 

I recently got diagnosed with cancer and had to take a leave of absence from work. I’m currently receiving disability payments but it’s not nearly enough to survive and not even close to my income I had with my job.

 

I have been on disability for 6 months and i have exhausted all of my savings over the past few months.

 

I go back to work Jan 9th and I will be in a better position to catch up on things. But in the meantime I have about a week to come up with the remainder of my rent so it can get paid in full by Jan 5th.

 

I’m a bit embarrassed to make a post like this, as I typically am very independent and do for myself and for others.  But I have learned to lower my pride before me and my kids end up homeless.

PLEASE HELP SINGLE MOTHER FACING EVICTION

Keeping a roof over my kids’s heads has cost me everything

Hello~

My name is Terrie and I was forced to retired early due to a back injury. I was in very good shape, financially, so I wasn’t concerned about having to quit my job to pursue my recovery process. However, I ended up co-signing for an apartment for my daughter and her kids to live in after a bad break-up with their father.

I co-signed the apartment for her trusting she would pay her rent as she has a very good job. Well, she was unable to keep up with her rent as she ended up with health issues of her own. I cashed in my 401k and brought her up to current on her rent to prevent her being evicted and affecting both of our credit. The apartment manager required me to have the rent pulled out of my bank account as an automatic monthly payment as a condition for her staying in the apartment. well, to sum up, I no longer have any savings or retirement account and had to start using my credit card to cover the rent so my grandkids didn’t end up homeless

She has a cheaper apartment, now, and is managing her rent payments. However, I have no safety net and I am over $10k in debt and am having trouble making my own housing payments, as my $1,360 a month I get from SS isn’t covering my CC payments and my monthly expenses. A friend is letting me live on his land in my very old RV for $500 a month, but with almost a third of my income being used to pay my minimum CC payments even this has become a challenge. I have been praying for a financial breakthrough and was told about this website. It is my fervent prayer that some Angel will be able to help me get out of CC debt so I can, again, be able to live off of the SS I get each month.

I Just Need a Second Chance. Please

Hi there. The name Johnpaul Joshua is my. I’m known by many as JP. I currently reside in Florida, however, my hometown is New York City. My two lovely daughters, Alexandria (Ally) and Gabriella (Gabby), are my. Gabby is six and Ally is eight. When I got home from work on November 9, 2023, I was given a 24-hour notice to leave my flat. The day following my birthday was this one. My dog and I had to go immediately, so I hurriedly packed my belongings. My finances couldn’t support the $1400 rent, utilities, and other costs. I also have to pay child support every two weeks on top of that. I lost my dog a few days later.  He was 14 years old and already sick.

My girls would lose their hearts if I told them this, so I haven’t. To provide them with a cozy location to sleep, I utilize my earnings to pay for lodging for the weekend. Every other weekend, they spend time with me. I move back into my car after they return to their mother.

You may see a glimpse of my personality by visiting my Facebook profile. I don’t use drugs or alcohol, I’ve never been arrested, and I’ve never been the kind of person to run the streets. From New York to Florida, I have mentored innumerable boys and girls. I’ve always made an effort to be a helpful adult and a good role model for the kids I’ve encountered. Unfortunately, I recently had a poor break.

In January, I took a chance and entrusted a man $2800 of my savings to buy a box truck, only to have my money and labor stolen from me. He assured me that I would work with him and his companions and earn a nice living, but instead of paying me and leaving the truck without me, they stole my money. They now get to live and eat well, while I live out of my suitcase and gym bag and sleep in the backseat of my car.

I participate in the Active N Fit program, which costs just $28 a month and gives me access to several gyms across the US. I can take showers here, so this is useful. I take advantage of the circumstances. My belongings are in storage, but in order to get money, I had to sell a lot of them. I was training my girls to play drums, therefore it was painful for me to have to sell my drum equipment.

In the end, I merely need assistance renting a room while I save up money for an apartment. With one eviction under my belt, that will be challenging, but I’m optimistic. I’m so disappointed that I can’t give my daughters the Christmas they deserve. I cherish my children. July was my planned wedding month, but things are not looking good. My fiancée is an incredible woman who continues to love me despite this trying moment. I’m renting a room to her for roughly two hours right now. I mean, I live in my car, yet she still calls me king. How many ladies would be pleased to be associated with a homeless man? Having the ability to provide for such an amazing woman is my heart’s desire.

I’ve been endowed with the ability to succeed. I’m 49 years old, a preacher, a fitness enthusiast, and a swim instructor who has worked with kids for 30 years. I’ve penned a children’s book that I’ve dedicated to my angels. Additionally, it stars Mr. JP, the puppet they selected and gave a name to. I need to locate somewhere to stay first, but I’m also attempting to raise money to help get it published. Mr. JP began as just a fun project for my kids to do and has since amassed over 12,000 TikTok followers. The kids adore him anywhere I take him. He would appear if you were to search for Mr. JP on TikTok. I composed a children’s book to give my girls something to make them proud of their dad, long after I left this world.
