When you sign a lease agreement, you do not intend to break it. However things can happen, Health problems can keep you from work, you can lose your job, or unexpected finances come up. The result is that you cannot pay rent. You may also want to break a lease to get out from underneath a bad landlord. Or to get away from a neighbor. It may not be expected, but there can be times when breaking a lease is necessary.

Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.

Here are six important tips to protect yourself should you face an eviction.

  • Know the laws

Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.

Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

  • Keep records

From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.

It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

  • Consult with an attorney

It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

  • Go to the hearing

You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.

Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

  • Handling an eviction

In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

  • Getting another place

Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.

Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.

Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.

An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.

Facing Possible Eviction

Thanks for viewing my story! My name is Tiffany, I am a 35 year old single mom of two sweet and humble kids. My son who is 13 and on his way to high school this year and my daughter who is 5 years old starting kindergarten soon. In 2022 I moved out to North Carolina from New Jersey, as I was suggested by a family member who had already made the move, in desperate need of a new start from eviction and hard times due to unfortunate circumstances. Me and my family’s journey to settle where we are now have been tremendously challenging. I came here with just a small plan, caring for a baby who was just 1 and a half years old at the time. Finding affordable childcare for my baby was my first challenge and I was not fortunate enough to have someone look after her until I completely got back on my feet. But I was able to have my sister look after my son until he completed his last school year in our hometown. Regardless, I still was in deep need for consistent and reliable childcare which was a struggle for me to keep up with little to no support system. I didn’t know many people here and the family here that I did know was not trying to support me fully, but I still appreciate the things that they were willing to do to help. At the time I was staying with my aunt, and finding employment right away was never an issue, I had a hard time maintaining my jobs due to babysitters canceling on me or having to pull my child out of daycare that was super expensive and overwhelming in comparison to my income. Eventually I had ended up finding childcare assistance programs, but even with assistance the bills were pretty high. This was the making of 3-4 years of a wilderness season for me. My family and I have been homeless, sleeping in my car, and in a shelter for a good 6 months out of that time. Ever since I arrived here I never got the chance to rest or escape survival mode.
Fast forward to now 2026, I am currently, possibly facing the same situation. As I am currently in an apartment since April of 2024, In the start of this year (2026) I was let go from employment and have been having a hard time finding employment that works with my children’s schedule. My daughter who is 5 now, will be attending public school soon but until then, I have no income or a current way to pay off my accumulation of bills. I am currently behind over $12,000 in rent, and what I had saved up I was barely able to keep up with other bills like, gas & electric, car insurance, phone, food, etc. However with my youngest child starting school soon I am hopeful that I am able to pull us through and recover from these circumstances. Apart of my plan of finally breaking free of poverty are some minor investments I have in mind that could lead to major restoration for my kids and I. With all this on my plate I had fallen into a deep depression, but because of my faith and religion I have managed to pick myself back up and keep going for myself, for Jesus and for my kids. Eviction Notice – Pastor In Need Of Assistance

Hello, my name is Pastor Anthony Draxx and I am in dire need of financial assistance as my wife and I received an Eviction Notice to pay or vacate on 6 May 2026 (with 72 hours to pay). I tried to get assistance through various agencies including the VA (I am a Combat Veteran that served 1987-1995 and did black-ops as a sniper, the government sealed my records so tight even the Army cannot see my duty records. I petitioned the Senate Arms Committee through a federal judge and all we received was 43 pages of red-acted paperwork that only showed my name and social security number) no dates of service, no readable discharge information, absolutely nothing readable. And because nobody can see anything (not even my discharge papers DD-214), I cannot receive any benefits through the VA and supporting agencies like Goodwill Industries (though I must say workers did try to get supporting documents and help us). I am not upset with any agencies because I know the people did their best with what was given them to work with. Because I have petitioned higher authorities my apartment manager has put eviction on hold temporarily. But they cannot continue to let my rent go past two months, which is now just short of $4,000 with rent/late fees/administrative fees for May and June.  My military service is what lead me to become an Ordained Pastor for Lighthouse Ministries in North Idaho (and previously in Oregon). I am honestly depending on God and the Hearts of Good People to help my wife and I through this rough situation.  I have spent the last few months trying to get employed at way over a hundred places, so we can get back on our feet. I am sure something will happen soon, not everybody will say no to me (I am 58 years old and trying). May God Bless You All…!

Help a Senior stay in her home.

It’s not a complicated story but a righteous one. I’ve worked 50+ years of my life and was looking forward to seeing some of the world and relaxing these old bones.

I started off right put aside my retirement funds and never touched it until it was time.

My body started to fail me and I couldn’t work as hard or as long as I used to. So I retired from the workforce and adopted a tuxedo cat named Princess Grace. She had a baby and then there were 3. Me, Grace and Gugu Pearl.

Things were going great been living in my apartment for three years. And then…things changed and someone new came into power and started messing with the old people and the veterans and the poor people.

The first government shutdown affected my retirement funds and the second affected my social security funds.

I got behind in my rent trying to pay late fees and penalties for being late.

No I’m facing an eviction and I need help. Just enough to catch up and then I can stand on my own again.

I’m two months behind trying to get help from Social Services and Senior Citizen programs. Unfortunately, the same reason I’m behind is the same reason there is no funding to help those who need it.

Emergency – Facing Eviction and Termination of Light & Gas

I am 9 months in arrears to pay rent to my landlord. I have been served papers to face an eviction court hearing  on June 11, 2026, of which the only way to stop this eviction is to pay what is owed and just yesterday I also received a termination notice pertaining to arrears owed to my light and gas company. I have been facing over a year ana a half of so many challenges and hardships with trying to find money to pay my car note, insurance for the car, groceries, water, telephone, internet, etc. The list goes on and on.  My daughter graduated last year and she has only been able to get a part time job.   I run 2 businesses from home  of which the income has been drastically reduced due to loss of work and experiencing illnesses for over 2 years.

 

I have been affected so much and have been trying to keep up with all of the bills despite all of these challenges. Now I am at a place where I have run out of any resources and help that I can get.  I am barely making it to put food on the table, pay for gas, car notes, etc. My credit has been affected in so many ways to be able to get help with obtaining even a credit card to be able to buy food.  My health has been so affected with more anxiety and additional stress because of having to think about what is going to happen. I am currently and actively looking for work and doing everything possible to get some relief.

Single mom of two facing eviction

Hello! My name is Melissa. I’m a single mom (for 14 years) and I am in danger of losing the home I rent in St.Augustine Florida. Help Me Save My Children’s Only Stability Before Court in 2 Days

For the last 10 years, I have carried more loss and hardship than I ever imagined possible, yet I have always done everything I could to keep moving forward without asking anyone for help.

Ten years ago, on my birthday, my husband was tragically taken from me through an act of violence. Five years later, I lost my second spouse unexpectedly to a brain aneurysm. Then, two years ago, I lost my father as well. Through every loss, every setback, and every moment where life felt unbearable, I continued to push forward the best I could for myself and, most importantly, for my children.

My children have experienced so much heartbreak and instability throughout the years, and through it all, this home has been the one place that has provided them comfort, consistency, and security. It has been the place they could count on when everything else in life felt uncertain. The possibility of losing our home is not just about losing a place to live; it is the possibility of losing the stability that has helped carry my children through unimaginable grief and change.

Last year, after already struggling to recover emotionally and financially from years of loss, I lost my job. The very next day, I was involved in a severe T-bone accident that left me injured and unable to quickly recover financially. Only weeks later, I was involved in another accident that further worsened my previous injuries. I am still actively receiving medical treatment and working through the compensation process from these accidents while also trying to replace my vehicle. These unexpected hardships are ultimately what caused me to fall behind financially in the first place.

I have always been the person others could lean on. I have always tried to figure things out on my own, stay strong, and help others whenever I was able. Asking for help has never come easy to me, but today I am facing one of the hardest moments of my life.

At this time, I am trying to raise a minimum of $13,500 immediately to help prevent the loss of our home, while the total amount needed to fully save it is approximately $43,000. Despite everything, I have not given up. I am still fighting for my children, for our stability, and for the opportunity to rebuild after an incredibly difficult season of life.

Single women trying to take care of mental nephew

I am 61 years old and I am now 3 months behind on rent and getting evicted,I am having a hard time getting a job and I also take care of my nephew who is extremely mentally ill and he has manic episodes so bad that he can’t go into public

Single Father with Disabled Son

Single Dad trying to dig out of a Hole. Work has taken a hard bad down turn and trying not to get evicted on top of it.  Changed jobs just not happing fast enough to stop everything from crashing to the crowd. My rent with the late fees is approaching $5,000 and my truck has died, and will need to find me another one on top of it all.  A used truck here  is gonna be about $8,000. so all together $13,000 I can get back to work and some what a normal life. I use internet at McDonald’s. Shut ever thing nonessential off cable, cellphones.  Almost to the point of sending my son to live with his mom in Texas and will kill me to give him up. I live if FL and will probably never get him back. He has lived with me since he was 4. 

I have applied at numerous agencies as well as churches trying to get assistance of any kind. Nobody has funds of any kind and most government agencies have no openings to even be on a waiting list at all.

Hoping to find good hearted and caring people willing to donate to help us out on what’s becoming a living h**.

Have never done this before have always managed some way some how. I have swallowed my pride to do this for the sake of my son. he doesn’t deserve this at all and have run out of place to turn. Starting Over After Domestic Violence – Trying To Stay Housed

I never imagined I would be in a position where I would need to ask for help like this, but I am doing everything I can to rebuild my life after leaving a domestic violence relationship.

Leaving that situation was necessary for my safety, but starting over has been incredibly difficult financially. I had to come up with two security deposits just to secure a safe place to live and begin rebuilding my life.

Around the same time, the restaurant where I work experienced an electrical fire and the state shut us down for about four weeks. Being out of work for that long put me in a very difficult financial position and caused me to fall behind on important bills like my rent and car payment.

Since we reopened, I have been working six days a week in the restaurant industry, doing everything I possibly can to catch up and stabilize my life again. I’m trying my hardest to move forward, but the combination of leaving an abusive situation and losing a month of income has made it extremely difficult to get back on my feet.

I’m also doing my best to keep stability for my puppy, who has been my comfort and emotional support through everything I’ve gone through. Right now my biggest goal is simply to keep a safe place for both of us while I continue working and rebuilding.

Any support, no matter how small, would go directly toward housing and basic living expenses while I get back on my feet. Even sharing this fundraiser could make a huge difference.

An orphan who lives alone.

Hi there, hope you have a blessed life!

My name is Jan, living alone since 11, now I’m 31. Have been struggling all my life. Couple months ago get into terrible work accident from which I still recovering. I can’t work for next two months and I don’t know if I will be recovered after that.
Unfortunately my savings will end very soon and I have to look for help somewhere else. I ain’t got any family or close friends who could help me, I’m literally pushed to seek help or I will be throw out in street. This is the last month my work is covering my sick pay and that’s just to cover my bills and food. I wish, I would have something happy to say too but somehow the life always gets me in the worst way possible. 4 Days Until Eviction

Hello,

I am really losing faith and finding it hard to want to carry on… A little over a year ago I lost my job. I’ve applied in person and online, walked miles, been to countless interviews… and nothing. Unemployment ran out months ago. I got behind on my rent, and my mailbox was marked as abandoned so I never received notice of a court date for an eviction hearing.

I am the only caretaker for my elderly father. He has heart failure, and due to injuries when he was younger can’t move around all that well. He receives a small amount monthly which we’ve used for keeping the heat on and enough groceries to get by.

I thought things were starting to turn around. I got a job finally, last week. My landlord won’t accept a payment plan. My only options are to pay them in full, or leave.

Currently I owe $12,250. I can maybe cover 10% of that on my own. But there is no way I can get the rest in the next couple of days. I don’t know what else to do…

Eviction in housing court

Hello good people –  Normally I am not a begging person.  I am in a most dire situation.  Please, let me explain…  I have an apartment in Minneapolis Minnesota USA. Where I’ve been living alone for a few years.  My beloved father and only living family member very sadly  passed away suddenly on April 3rd of 2025.  Which let me alone to handle the things.  I thought that I should move into his house and be able to be around his home and things.  I remember him and  so many of his things from my childhood and truly enjoyed being there with all my memories.  While in transit between my apartment and his home someone broke into his home while I was away and destroyed most everything and flooded the entire place.  I spent my money on the house note and repairs for months until I finally realized that I just couldn’t afford the situation and sadly have had had to take what was salvageable and walk away.  While doing this I had ignored my rent payments for my apartment and have since been in housing court facing eviction.  They’ve given me a bill of $4,534.59 which I’ve paid $1,000.00 of as of yet.  They’ve given me until March 29th 2026 to pay the remaining $3,234.59 of which I have none.  Today, I am begging you good people to please help me stay housed as it is extremely cold here in Minneapolis.  And, I am quite certain that you’ve all heard of the horrors that the ICE agents have been causing on in our neighborhoods and in our streets here in Minneapolis.  Which also means that the cities funding has been stretched to the breaking point by all the chaos and hardship.  I see my mistakes now and going forward I will be able to pay my rent in the future.  I realize that this is a lot to ask of people who don’t even know me.  With no family and my city in chaos I have nowhere else to turn.  Please, keep me from the cold outside.  I truly thank you for taking your time to read my story.  God is good we all need God’s love and to love each other.

Help family of 5 keep home

My family and I are in dire need of help to keep our rental home. After losing income over the holidays and being overextended for emergency pet surgery that didn’t save our dog, we have been served a 3-day pay-or-quit notice. We have no relatives in the area, and we’ve exhausted our efforts asking friends and family. Unfortunately, my spouse and I can’t get approved for any loans at the moment.

Our children are at a critical moment in their education, and household income depends heavily on staying in our area. This house has been a blessing to us and is far more affordable than any other housing we can find. Not to mention, given our credit situation and loss of income, even if we had the money, it would be nearly impossible to get approved for a lease anywhere else.

Our last remaining option is to somehow raise the money. It is very humbling and difficult to ask, but I know this is the last line of defense in keeping my family off the streets.
