I am a single mother, I am facing losing my home tomorrow. I received a notice last Friday. I have been working on resolving this issue for weeks, and have had absolutely no luck. Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.
Here are six important tips to protect yourself should you face an eviction.

Know the laws
Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.
Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

Keep records
From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.
It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

Consult with an attorney
It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

Go to the hearing
You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.
Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

Handling an eviction
In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

Getting another place
Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.
Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.
Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.
An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.
Stroke Victim Being Evicted Needs Help
On April 5th my 65 year old mother had a massive stroke and nearly didn’t make it. She’s been making very good progress in her recovery to the point that she is already at home. She was unable to go to the management office at her apartments in order to renew her HUD certification and they have given her an eviction notice stating that if she doesn’t pay $1440 by the 6th of June she will get a 7 day notice to quit. We have no way to come up with that kind of money due to both of us being on disability. Now to top it off my car broke down and I won’t be able to get her to her upcoming appointments to help continue her recovery. I am pretty intelligent but when it comes to cars I am mechanically illiterate so we have to find a way to pay someone to fix it. The battery terminal broke so I replaced it but now the car won’t even roll over. I’m at a complete loss right now, I’m past the point of being exhausted because I’ve been going nonstop since she had the stroke. I guess maybe there’s a silver lining to the car not running, I’m being forced to just stop and not do anything so in a way I’m being forced to take a break. I don’t know how much it’s going to cost to fix the car but I’m assuming its not going to be cheap. With that being said I guess I’m asking for help with at least the eviction notice which is $1440 plus anything extra I can get to put towards the car. Managers Declined My Disability Doctor’s Note and Now Facing Eviction
As a mom of three always providing for us all on my own and always struggled to ask for help, at this time I have no choice but to ask for financial help so we can keep our home and not get evicted. We recently moved to Las Vegas from California due to the cost of living being less than California and more opportunities to create multiple streams of income.
I got into an hit and run car accident that lead to me losing my job because my managers declined my doctors notes due to being short staffed. I tried to continue my job after treatment, but my hands keep going numb after typing all day. The car accident caused nerve damage resulting both arms going completely numb. I am writing this with hope that I will get help coming up with $2150 to pay my rent. Back in February, I underwent knee replacement surgery. Hello, my name is Dawn and I’m requesting financial assistance to cover my past due rent to avoid being evicted and help for an additional three to four months until I am financially secure again with full time employment.
I’ll share a little bit about my background over the past year and a half that is partially a factor in the importance to me to keep a roof over my head and a place to call home. I had been homeless for approximately 1 1/2 years since July of 2022 due being put out of a home I was renting without much notice when the owners decided to put the property up for sale. Due to this unexpected event I became homeless and lost employment. Luckily I had a vehicle that became my new home for a lot longer than I expected, but I was thankful. Over the next several months I learned a lot about myself, my strengths and abilities I had forgotten I had, a different side of people and the limited resources available to a single woman with out any dependent children to care for. I didn’t have the best of luck with getting a good job or finding a decent place to rent so this was my life for many months. I feel God placed me on this journey for a reason and I would finish it out in His timing. He was always there guiding me, helping me stay positive and not give up. The last 6 months I was blessed to stay with a friend at his apartment until it became infested with bedbugs and roaches, very inhabitable to the point he injured himself. After battling with his landlord he was ordered to leave so again, my vehicle became my temporary home. Luckily, soon after I secured a good career allowing me to rent a room for a little over a month. During this time I was able to save enough money for a deposit and first month’s rent for a place to call home. After weeks of searching, I found a beautiful place that really caught my eye in a location I wanted to be and a landlord that was willing to work with me (due to being homeless my credit took a hit giving me a low score). The monthly rent was more than I ever wanted to pay, however, I had been homeless for so long I wanted to make it work. I looked at my budget and decided I could do it as long as I stayed within my budget. As mentioned, with me having bad credit I was approved, but with conditions meaning I had to pay the normal deposit that was more than rent, my first month’s rent, pet deposit, application cost and the condition being an additional month’s rent as a 2nd deposit. I had enough money saved for everything except the 2nd deposit so I pleaded with the new landlord to let me make payments on it. He finally agreed to 3 months of $700 for the first 2 months and $650 for the last month due on the 15th of each month. I paid over $5000 to move in the last few days of January. A side note, rent is due on the 25th of each month and late 7 days later so he states the 2nd of each month. I paid $700 on February 15th as agreed for one of my payments towards the 2nd deposit. The end of February came around and I planned on using the majority of that check with some money I had saved from my prior check to pay rent. The check arrived direct deposit into one account but was considerably less than normal so I waited a 1/2 day to see if the remainder showed up in my other direct deposit account, but it had not. The next morning I asked my boss who stated she didn’t know what was going on so I called HR at our corporate office to find out I was being garnished and they were taking 25% of each check which made my check almost $1000 less each payday every other week with my normal taxes being deducted and now the garnishment. I let my landlord know what happened and I would have everything to him but would I be a couple days late. In the mean time my health started going downhill with my blood pressure becoming extremely elevated with one reading being 199/118. My boss sent me to the ER and told me I needed to stay home a few days. So now my stress levels were even higher knowing I have a garnishment and less hours on my next check which in turn kept my blood pressure elevated causing my boss to send me home again the following week. I tried to stay positive reminding myself I have a part-time caregiver job I work that will help supplement what I needed to pay for March’s rent. I kept working hard, trying to prove myself at this fairly new job, trying to keep my stress levels down to help my heart health. I was able to borrow a little money, use the money from both my paychecks to pay March rent. Then the 15th rolls around (2nd deposit payment due) and I only had $200 so I paid him. He added late fees and PayPal fees so I then paid him the remaining $500 plus those fees. Right after I paid this my boss called me into the office to tell me she doesn’t think I’m where I should be after 3 almost 4 months working my position. She stated “you are a wonderful person and I will put down that you are re-hirable but in the best interest of the company we are letting you go”. I begged for my boss to let me do a different job within the company so I wouldn’t lose my home because she knew how hard I worked to secure a home, she knew I was being garnished and she’s who sent me home all those days causing me to have less hours each paycheck. She said no and that was that. I had $150 left to my name so I sent it to the landlord to go towards April’s rent and started job searching and finding resources to pay my rent that is now due in approximately 2 weeks. I scrambled to find the remainder of my rent. I was able to borrow a little money from a family member, use money from my 2nd job and the money from my last check to come up with $1375 to send him. With the payment I sent an email explaining I apologized but would have the remaining money to him before the 15th. That evening when I went outside he had posted a notice on my door (dated April 3, 2024) demanding I pay him $736.12 (total of remaining rent and his additional fees) within 5 days (April 8, 2024) or he is evicting me for possession. I don’t have any additional resources for help so I’m reaching out to you requesting help with the remaining $736.12 for rent, $650 for the last payment of my additional deposit that is due on the 15th and because rent will be due again on April 25th, an additional 3-4 months assistance so I can get back on my feet finding full-time employment that pays well enough to stay here. Or at least enough to stay here a couple months until I find employment and a new place to live, put my 30 day notice to leave in so I can remain compliant with my lease terms. My current job salary isn’t enough for our bills and my kids have never gone to school due to lack of school requirements like fees besides that my kids have never had a good life as every month I’m struggling to pay rent and give them food not to starve that’s our life. However I believe God will one day bless the work of my hands. I’m working part time jobs to supplement on my salary, and my dream is one day being a successful entrepreneur lady and maybe coming on this platform to give donations to someone else not begging . I started some entrepreneurial free training to fulfill my dream through at times I don’t have data/Wi-Fi but I believe in God I will succeed.
