When you sign a lease agreement, you do not intend to break it. However things can happen, Health problems can keep you from work, you can lose your job, or unexpected finances come up. The result is that you cannot pay rent. You may also want to break a lease to get out from underneath a bad landlord. Or to get away from a neighbor. It may not be expected, but there can be times when breaking a lease is necessary.

Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.

Here are six important tips to protect yourself should you face an eviction.

  • Know the laws

Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.

Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

  • Keep records

From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.

It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

  • Consult with an attorney

It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

  • Go to the hearing

You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.

Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

  • Handling an eviction

In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

  • Getting another place

Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.

Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.

Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.

An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.

Struggling to survive by myself after 23 year marriage

Hi,
I am starting over after my 23 year marriage ended in divorce. He was the provider since I broke my back and I’ve undergone 6 major back surgeries. I am having a difficult time making ends meet. Rent

Hello, I am currently 4 months behind on my rent. I really need help getting this paid or I could possibly lose my place. I moved to Los Angeles, California in 2022. I was living with a friend, sleeping on her couch. We suddenly found out the end of January of this year, that we had 3 days to move. The place I’m currently living at, I found just in time. Unfortunately, soon after I moved into my new place, the job I was recently hired for turned out to be a scam. I worked as an Independent Sales Representative for Spectrum, which turned out to be door to door. Those details were left out of the job description, but I still gave it a chance. It wasn’t a good fit and they never paid me what I was owed. I was there for a month and I only got compensated for orientation. I also had another job as a Virtual Assistant. When I went to deposit my checks into my account, I found out the checks were fraud. So I have been through quite a lot when it comes to employment. I have sent my resume to numerous companies, I have been on countless interviews. The responses have been “you’re overqualified”, “you’re under qualified” or “you don’t have enough experience”. However, I’m still looking for employment. I won’t allow the disappointments to force  me to quit. I have reached out to lots of family members and friends, and no one has been in a position to help. Which led me here. Paying off this balance is my main priority at this moment. Another thing I would like to share is, in 2022 I started a clothing/apparel brand. I haven’t had the right funding to invest in my business like I would like to. I know my business will be very successful with the right funding behind it. This would also be my job, my means of income. I will turn my earnings into residual income, as well as a career. I just need a real chance. The success of this business would open so many doors for not only me, but everyone around me. I am naturally a giver, and I absolutely love helping others. Even when I don’t receive that same energy in return. I more I have the more I’ll be able to give. The more knowledge I gain, the more I can teach. Save Senior Citizen From Eviction

I have been living from paycheck to paycheck all of my life, so it did not take long for me to fall behind with my rent after losing my only source of income and now I am three months behind in rent payment. I lost my job when the company suddenly decided to close their doors with no explanation and no extra pay. I am a senior but not yet at retirement age and I don’t have a disability so I do not qualify for social security benefits. I owe $4,800 for rent and I’ve already been to court. They told me that I have two weeks to come up with the money or I will have to move. I don’t even have the money to move and don’t know where I would go. I don’t want to fail my family

I am here asking for help to pay my rent, water and electric bills that are due tomorrow and Tuesday. I messed up by counting on a job that I interviewed twice for, but the company has started dragging their feet. So now I don’t have enough for our rent, bills or food for that matter. I have never had to beg for money like this; I’ve always had a job and provided for my family. I have tried getting a small loan but ever since the COVID shutdown, everything has been tough. My wife can’t work right now due to mold poisoning. I was finally able to get us out of the house that was causing the issues in Houston TX and moved us to Florida. Disabled and afraid

Greetings! I am a 47 year old disabled mother in dire need of financial assistance. i was diag with NSLC Lung cancer in 2016. I hadn’t even made 40 yet and was given 6 months to live. Unfortunately the treatment that saved my life also crippled me.Though I had just graduated cosmetology school I was unable to work due to the side effects of treatment. After 3 years of fighting for SSDI I finally won. I was able to maintain a home(I’ve been here 10 years) until my last child graduated in May. I’ve fallen behind in everything and have not been able to pay my rent , cell phone bill or gas. I’ve searched for someplace cheaper than my current home and have found that it’s actually cheaper to stay where I am. I just need a little help to get me back on track. Bordering on homelessness

Hi, I’ve just turned 20 years old, and i’m about to lose my house due to the landlord selling it. my dad lost his job, and me and my mother barely make enough to get by. I’ve had to leave Uni behind to work 50+ hours weekly to try help afford a new place.

A young man in need of help from other humans for a better, new and healthier life in London, England.

Unfortunately, due to battling chronic BPD, and feeling afraid of my diagnosis and daily symptoms, I recently became homeless after succumbing to losing my flat of 12 years. I was a looked after child under the care of Brent Social Services from the age of 3 years old, because of a stabbing inflicted by my estranged father on my mother on my 3rd birthday. He stabbed her 18 times, and went to prison. My mother, vanished, more or less after being released from hospital and I went into care, although strangely I still had contact with my father, as he threatened to kill my mother if she tried to keep me in her care. He was violent in ways with me, especially if I misbehaved at school and all of this trauma for 30 years lead me to where I am now, with chronic BPD, anxious, homeless and currently living in a shelter which is surrounded by people who suffer from drug and alcohol addiction.

 

I just wish for a better life and some help from humanity, as well as somewhere to call my own, in addition to getting help for my condition. Right now, I feel totally hopeless and shameful too admittedly for using this website as my last resort.

Honestly speaking and painfully speaking, I haven’t had much in life in the way of people; hardly any family, carers who came and went, which is part of their job, I suppose, and 1 cat I love to death. I know there are people who are blessed to be in positions that can help people like me. I also give to those less fortunate than me whenever I have the means. I just pray someone can do the same for me. I would appreciate it very much. I wouldn’t even ask for any particular amounts, as I hate coming across as ungrateful. Sorry for the long explanation of my circumstances and thank you for all you decide todo to help me make a life for myself and start over.

VERY LATE ON RENT.

Hello . I have 2 sons 12 and 6 years old. We have 2 dogs boy and girl. We all live together with their dad. He is the only one that is working because I cannot because of the car accident I was in. We are struggling very much I do receive food stamps and medicaid but I have got all the help that I can get to go towards the bills. Joshua the boy’s father is the only one that works. Joshua had to change jobs so during that 2 week period time before he gets his first paycheck again of our bills are due. And it’s literally up to $2000. I am literally begging for anybody to help with anything. It would be such a true blessing and we will be so grateful. We lost our home in a fire in 2023. Then months later  we lost our home to the hurricane that went through Madison co. Florida.  Yep we was in it direct path.

Then we moved out of Florida and moved to Virginia Beach Virginia for a brand new start. We had a very rough life in Florida. From being having a great job and a great vehicle in a nice place to live to no job car wreck lost the vehicle lost the home to a fire and then basically was homeless. We got money from Red Cross when it happened and they are the ones that helped us with the hotels. But now boys dad has a job and it only gets paid every 2 weeks and it’s making us behind and hind and behind and behind and behind again. We really truly need some help we already got the eviction notice in the court date. Which is July 9th 2024 . Me and my family just can’t be homeless again and if we go to shelters they’ll want to split the dogs up but we’re not allowed to have the dogs and then their dad wouldn’t be able to stay with me and the boys because of him being a man they are do not let men  In women shelters. So we can’t be split up so that’s not even an option. Don’t have a vehicle because we lost it in a flood . So can’t sleep in it.  when we were doordashing and actually doing good and paying all our bills on time But then when we lost the vehicle we lost that income as well. Everything is just beginning to be very overwhelming. A friend of mine suggested this site here to see if I can try to get some help For our family so we don’t become homeless again. . Help needed in CO

I hope this finds you well. In Feb. of 2023, I lost my full time job. I was able to find another job within a week, but then I lost my second job 9 months after I lost my full time job. About 2 months ago, I was able to find another full time job closer to where I live, so I wouldn’t have to spend so much money on gas but I still need another second job to help with bills. I’m still looking in that regard. Up till this point, I’ve received 2 eviction notices but I was able to pay off the rent from the fist one. However, I’ve spent all my retirement and have taken out too many loans to keep up with the rent. I’m just asking for some help to catch up on rent and the loans I’ve already made. In order to do this, I need $15,000.00 to catch up.

I’m a 53 year old male who has no family but I feel like I’m starting to panic a little bit. I’ve also asked and received help from my family and from church but neither can help out now. I’m not sure if I qualify for help from the state. I’m trying hard to budget, but the lack of funds make that difficult. If $15,000 is too much, $7,500.00 would be great! I’m looking at other options other than asking my family and friends to see if they can help out. Like I’ve already mentioned, I’m working on budgets but I just don’t make enough money to even make a serious budget at this point. I do have an individual helping me out with that. Once I find a part time job, things will really improve, but time is running out for me. I’m not sure how much longer I can hold out and I’m afraid to mention my problem to anyone else at this point. I just don’t have the guts to tell everyone around me that things are getting worse and I’ve already made some poor choices. Maybe it’s a pride thing with me but I just don’t seem to have anymore answers. With all that’s going on, I’m afraid I’m going to have to hire a lawyer, which I don’t have the money for.

This sort of thing is shameful for me personally, because I’m still trying to find ways to make more money.
I’m a broadcaster by trade and, unless you’re in management, it doesn’t pay well for the most part. I’m going to need this money within 2 weeks.

I’m an honest person who would like to make a better life for myself. I’m just running out of gas and I’m not sure what to do. I don’t like asking for help and don’t consider myself an exceptional person. If possible, I’d like to do my part to make this world a better place, eventually.

I HAD COURT 6/12/2024 ON EVICTION NOTICE IT HAD 1250.00 PLUS COST OF COURT. I APPLIED FOR ALL TYPE OF LOANS, CHURCHES, SOCIAL SERVICES, BORROWING ECT, I GOT ALL THE MONEY UP CALLED THE MORNING OF COURT TO PAY HE REFUSED AND SAID I HAD TO PAY CUURENT MONTH ALL IN CASH WICH CAME UP TO 2680. OF COURSE I DONT HAVE THIS AMOUNT, I WENT TO COURT TO MAKE SURE THEY CAN DO THAT, JUDGE STATED YES THEY CAN ASK FOR CURRENT MONTH, AND ADDITIONAL MONTH AFTEER, SO JUDGED IN FAVOR OF RENTAL COMPANY ABD GAVE 10 DAYS BY LAW TO MOVE OR PAY IN FULL. BY OR ON 6/22/24.  I DONT HAVE FAMILY CLOSE THEY ALL 4-5 HOURS AWAY, PLUS I WOULD BE HOMLESS AND WITHOUT JOB IF I MOVED THERE. I HAVE A CAR PAYMEENT SO I WILL LOOSE MORE LEAVING MY JOB.

I HAVE FOUND APARTMENT IVE APPLIED FOR CLOSER TO WORK AND IN GREAT LIVING CONDITIONS.  IF IM APPROVED IN A DAY OR SO ITS 300 SECURITY DEPOSIT AND 400 TO MOVE IN. THEN 1390 ON FIRST OF JULY, PLUS GETTING ELECTRICTY ON, MOVING TRUCK THE REST I WILL MANAGE.  THIS IS ALL I NEED. OR PAY THE 2680.00 AN STAY PUT, EITHER IS GOOD BECAUSE I WONT BE HOMLESS. Almost being Evicted

It really saddens me to have to come to this website as I never thought I’d be in this situation. However, my house recently got broken into and 20,000 dollars was stollen from our safe. Police were involved, however, nothing was solved as there were no cameras in place. It’s been about 3 months now, and I have not been able to pay my rent. That money was 5 years worth of saving as I did not have the opportunity to do college due to having a child at a young age. Although I know this is a long shot, and I understand it so, however I am really in need of 6,000 right now in order to be able to keep my house/pay my missed rent from the previous 3 months as well as help with my 7 year old son.  Again, I understand if this is a long shot as well as understand that thousands of other people that need help. However, this has truly been my rock bottom. Thank you to anyone who even just reads this – even if you don’t donate. I appreciate any  time people take reading my story.
