When you sign a lease agreement, you do not intend to break it. However things can happen, Health problems can keep you from work, you can lose your job, or unexpected finances come up. The result is that you cannot pay rent. You may also want to break a lease to get out from underneath a bad landlord. Or to get away from a neighbor. It may not be expected, but there can be times when breaking a lease is necessary.

Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.

Here are six important tips to protect yourself should you face an eviction.

  • Know the laws

Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.

Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

  • Keep records

From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.

It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

  • Consult with an attorney

It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

  • Go to the hearing

You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.

Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

  • Handling an eviction

In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

  • Getting another place

Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.

Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.

Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.

An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.

A ray of hope m

hello  I am VANESSA ,life growing up what quite tough , bullied at secondly school , till it got that bad I left without taken my exams , which I never understory did why wasn’t anything done .

my live then seemed to settle when I met my husband , we had 7 children together , we open our own business , and for a short time things where good , until our shop was burgled , and burnt down .

After that depression set in , and husband was violent to me ,

this went on behind close doors for a few year ,

but never a less we seemed help and moved on together

a few years on we were starting to look forward to some time together after bringing up a large family but tragic struck , 2 Christmas s ago , my husband was rushed into hospital , and we where told he had heart failure . And where looking T about 5 year to live

he came home after 6 weeks in hospital , and things really started to put a strain on money . Then 6 weeks later in the April he woke up coughing and struggling to breath , and safely died in my arms .

No matter what I did or the paramedics did we couldn’t save him , now with funeral costs and debts and rent I am being to be evicted from my home with my disabled son and younger son . I owe 1,800 pound in rent and going to court for for outstanding balance of £700 funeral costs . I am presently living on £180 month universal credits  . Can any kind soul , find it in there hearts to help me and my family . I have tried everything from selling my clothes etc but can’t get myself of this mess , I would be ever so grateful for any help at all . Please give us a ray of hope  thanking u  VANESSA

Rent and credit card debt

Hello!

My name is Damian and I feel very uneasy writing this. This is the first time in my entire life I’m asking strangers for financial help.

Up until now I was doing considerably well, I had good job, was paying my bills on time and was working on my income property which to be honest is going to be my retirement fund.

Two years ago I met my husband and it was a love from the first sight. We had a rough start though. We wanted an apartment  so we put our income information together and went for a hunt. Unfortunately something was wrong because we were rejected at least 35 times!!! After doing some in-depth research I found out that the reason of all the rejection was my husband poor credit score.

I was not going to give up and with help of friends and family we got a nice one bedroom apartment in a very nice building.

After a year we got married and things were looking pretty good.

My happiness was short-lived, though. It turned out that not only my husband had debts problems, which were taking a big chunk of our income, but also few addictions. I was thankful for having him sign prenuptial agreement because it protects me, and him in that matter from being responsible for debts acquired before our marriage.

Trying to help my husband to overcome his addiction I ended up in therapy myself becoming co-dependent. The depression forced me out of my job. Now I’m looking for work but it’s a very slow process.

For last few months, I live in fear of loosing our apartment. we haven’t paid the rent for last 3 months. Our building turn out to be very disorganized and because of it I found out that they illegally overcharging us for rent. I placed a complaint in Department of Buildings and it looks like our rent will be reduced from $1620 to $1320 but it will take more then 2 years to process. So for now we have to pay what we signed for.

We owe them 3 rents of: $1620.

It comes up to:

$4860!!!

I went through all my savings, stopped payments of my credit cards so we could have money for rent food and bills. I had my cell phone cancelled for obvious reasons. My construction is on hold. Still I have  some medical bills but I worked out low payments so it will not go to collection.

Unfortunately my credit cards debt went to collection and I have been summoned to court.

I owe:

I’m trying to do all the right things and keep it together but with my husband addictions , piling up bills and threat of being homeless it feels like the whole world is collapsing around me.

I don’t want to be homeless.

I was recently discharged from a behavioral clinic on the account of my attempted suicide, I was committed for about 3 weeks and was out of work on sick leave but unfortunately did not have enough pto to cover my paychecks to keep up with my bills and now I am on the verge of being evicted from the only thing left that I have besides my job, my home. Not only am I soon to be homeless but Im also being slapped with a bill for $950 for my hospitalization. I bought myself until the end of this month to come up with my rent, it will cost me around $800 to settle it because of late fees etc. I only have $175 to my name right now and insanely late on all of my bills but I can find a way to pay for the other bills, I just need to keep a roof over my head. I don’t have a vehicle either, I live half a mile away from my job (thank god) so I walk to work everyday and it’s absolutely no issue for me, i’ve been doing it for 2 years now. I’m asking for $2000 just so I can get myself back on my feet, I want to use this money to pay my unpaid rent, light bill, and medical bill, and use whatever extra is left for food I guess because Ive been living off of eggs and grilled cheese sandwiches and I don’t know how long the little food I have will last. BUT if $2000 is asking for too much I COMPLETELY UNDERSTAND and I would happily settle for ANYTHING even if its $20. I never thought I would resort to this but I have no family and only a few close friends who are unable to assist me because they of course have their own financial issues to deal with. Even if this doesn’t work, life is worth living and Ill do whatever it takes to get myself out of this hole I have found myself in. I appreciate the time anyone takes to read this. Single mom facing eviction

I am a single mom to three kids and I took a risk that has now hurt me greatly. I quit my day job and started my own business, an auction and estate sale business, in which I immediately began signing clients. The downfall came when my first round of auctions closed, only one item sold, for $500 and I won’t receive payment from it for 2 weeks. I am behind two months rent and I am facing eviction in just 11 hours as well as I am facing my electricity being shut off as well. The items my clients have consigned with me have the potential of earning $23,000 if they all sold at just the reserve amounts, which are set below the estimated selling price by the umbrella auction company. My consignment agreements entitle me to 40% of the earnings. I managed to get the umbrella company not to take a commission from me as the seller as well as I arranged for the buyer to pay all shipping costs. I did not prepare for or even think about the items not selling immediately in the first auction. I am now scared what will happen to my children and me, all our belongings and our dog. I desperately need help and I have every intention of paying it forward when I am in the position that I am able to so if anyone could please help us clear this hurdle you will be helping a single mom become a proud small business owner that gives back to others in their time of need.

My children and I do not have any extended family, they are deceased, in which I could borrow the money from or even to temporarily live with upon eviction. I have not ever received child support, nor will I ever receive it, as their father is in prison for sexually abusing our daughter, his own child! I stripped his parental rights in the divorce also stripping my rights to child support.

My children and I have already had to overcome so many obstacles and we could definitely use a break in life. I’m desperately searching for a part-time job while I continue to work on launching this new business which I do believe will become highly profitable.

Facing Homelessness Soon

Attached is proof that I have an eviction notice from my home. Me and my 6 year old daughter are meant to leave the home in a month.

Last night my daughter asked me, “mummy, do we still get to keep Ringo?”, who is our dog. I didn’t have the heart to tell her we can’t keep Ringo because we don’t have the money.

I thought my partner was paying the rent over the past two months, but as I learned he had planned to leave long in advance and cancelled his scheduled payments, and hidden letters from me that asked me to pay the rent. My partner broke up with me last week, which absolutely destroyed me, but I know is a good thing as he was nasty and rough with my daughter. However since he’s not here to hide the mail I’ve recieved this notice to move out.

I’ve been kicked out because my abusive ex stopped paying the rent. I don’t have money to afford a lawyer as I struggle to even pay for meals for myself and my daughter now that he’s gone. My daughter keeps asking when ‘daddy’ is coming home. I haven’t slept in two weeks.  I’m 39 and have been unemployed for a while due to the fact my partner was financially supporting us, so it will be near impossible to find a job. My parents disowned me many years ago when I told them I’m bisexual and had a female partner at the time.

My food comes from the food bank, and I recieve a small amount of money from the government for being in a crisis situation, which barely covers anything. I still won’t be able to get enough money to afford even just a small unit for me and my daughter. She is six years old and beautiful, still so optimistic in these times but I will not be able to support her and I do not want her taken from me.

Please, if anyone could even donate the smallest amounts it would mean the world to me. It would be a filling meal for my daughter, it would be money I can put towards getting a home for us.

My future in your hands

Hello I hope your having a blessed day. If this message finds you I hope you your heart is full of understanding. I would like to stay anonymous, being that my name is one of a kind and I’m a little embarrassed to post on a public page. It took a lot just for me to write this. I am 19 years old and I just started living on my own a year ago. I come from a family who has always struggled on the poverty line  my whole life. So growing up watching my single mother struggle to support four kids, I decided I wanted better for myself so I put in as much work as I could under my circumstances. I started with barley many help at the age of 18 got myself an apartment and a car from working two jobs. I was doing great until the hurricane hit (Florence) and I ended up losing my job and most of my belongings. Which set us back in bills to 2,000$ and we were evicted from our home. Im currently living at my cramped elderly uncles home on a small air mattress,  just looking for ways to eat day by day. I don’t start my new job until January 7th I have all the paper work to prove it, and even when I do start it’s gonna be a while before I can do this on my own. I do have bills and receipts evidence of the amount due I just didn’t post it on the actual post because again I don’t want to put my personal info out there. I am willing to send any pictures needed I’ll even give you the phone numbers to call and verify. I’ve been working really hard trying to get this paid off and now I can’t even move into a new home until that amount is paid. I wouldn’t dare ask anyone of anything, I’m usually the one to give but for once I’m willing to admit I need help. I need someone gracious enough to help me get out of this hole I was never taught how to get out of. I pray that you find it in your heart to bless me with any contribution from 1.00 to the whole 2,000 anything will help me please and thank you.
