When you sign a lease agreement, you do not intend to break it. However things can happen, Health problems can keep you from work, you can lose your job, or unexpected finances come up. The result is that you cannot pay rent. You may also want to break a lease to get out from underneath a bad landlord. Or to get away from a neighbor. It may not be expected, but there can be times when breaking a lease is necessary.

Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.

Here are six important tips to protect yourself should you face an eviction.

  • Know the laws

Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.

Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

  • Keep records

From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.

It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

  • Consult with an attorney

It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

  • Go to the hearing

You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.

Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

  • Handling an eviction

In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

  • Getting another place

Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.

Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.

Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.

An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.

Another American Cliche

Hi! Another struggling single mom here. Nice to meet you.  For the last 25 years I have worked with small children with a specialty working with autistic children.  I am awesome at it.  I wish I was in preschool right now. Well I can’t. Mostly because I can’t support two adult special needs children who are not currently receiving disability or any financial assistance on $17 an hour. No matter how excellent I am at getting a nonverbal child to communicate my pay even with a college education can’t support a family of three.  And dealing with the system or finding help on line is simply maddening.  We had our food assistance cut this month for “refusing to show proof of income”  How do I show proof of income when I have no income?  I lost my job in December and have been unsuccessful so far in finding any kind of employment that fits my physical and transportation needs.  My car was stolen in December as well. I’m sure it made it to Mexico before I even finished the police report.  I am so grateful for the public transportation system here, but it bites. First they are not the greatest at being on time so plan an extra hour to get to work. There’s also the  walking distance to get to a bus stop.  I’m really lucky I live right next to the light rail. Unfortunately it is not possible for me to walk the half mile to get to one.  I have a degenerative disease in my back and my feet are burning  insane.  Have you ever had pain so amazingly terrible that you just had to just stand in awe of the fact that you can withstand it and still partially function in society?  I live with an average daily pain level that hovers around a 7/10.  That’s on a good day. Most days I can hardly hobble across my tiny apartment. Think waddling penguin style.  Needless to say but I shall anyways, I can’t work an 8hr shift pretty much anywhere.  I won’t make it longer than 2-3 hours on my feet and 1-2hrs having to sit. It also just makes the pain almost take your breath away and you cry yourself to sleep.  So I’ve spent my time being unemployed teaching myself updated skills for our current employment scene.  I must find a gig I can do from my home, but even after studying 12-15hrs a day I still haven’t made a dime. There are so many shysters out there that take you to the brink of making a dollar and then they dangle you over the edge and ask an already cash poor human to cough up $997 for help.  Or you can trying finding an agency or business to help only to find out its just one stupid survey after the next of the same questions of lack and you end up getting literally receiving 94 phone calls a day from people claiming to help but want cash up front to do so. Where is that supposed to come from?  Rent in Phoenix is top notch and who can’t appreciate paying $2000 for a tiny two bedroom apartment.  How bout food? $100 doesn’t cover groceries for a week. Well after 3months of being out of work I find that I have gone through my savings and gracious friends and I need help.  If you knew how nauseatingly difficult it is for me to ask for help you’d be on your feet applauding and whispering finally.  I’d like to ask for $75,000 so that I can get out of my upcoming April 2nd eviction hearing, start some income streams and basically live normal. Not worry if the card is going to get declined for toilet paper. I am a hard working, intelligent, creative individual who has been called to find their light. If I’m so divinely chosen can that come with a pay upgrade?  I wanna know how if feels to not have fear every day.  I want a little security and stress relief, maybe go to a dr that specializes in joint relief.  Yeah I move and scream.  It’s a fun scene.  I have the motivation to make an online business successful. Create engaging technology geared towards the autistic niche since that’s where my talents resides.  In a perfect world a handsome dark haired millionaire reads this and just drops me $150k, keeping me afloat for many days.  Oh what that could do to my confidence and change the whole trajectory of my life. Husband left – Mom of 3 kids – Losing my home because Landlords are selling and I can’t find work

I am a single mother of 3 (one child being 3 years old recently diagnosed with autism) located in the Los Angeles area. In November, I fell down the stairs and sustained an injury that required me to have surgery on my leg. I broke my tibia, fibula and displaced my ankle. I was left unable to walk for 2 months. I was laid off from my job prior to the fall during the writers/SAG strike and I have been struggling to find work ever since. Shortly after the fall, my husband of 6 years left me and my children (while I was recovering from surgery and still unable to walk, nor properly care for my 3 year old). In February I began physical therapy and a week after that I received a call from my Landlord stating that they were selling the home that we rent from them due to them getting a divorce. (I can’t make this stuff up) I had been using the last of my savings to pay rent since I now have the burden of paying for everything myself and that left me without much money left to pay off items on my credit needed to put myself in a better position to move or with anything to show in my account so that a new home or apartment would accept my family and I. Three weeks after finding out that we had to move, my daughter was diagnosed with Autism. I have interviewed for 6 positions over the last few weeks and was not hired for anything. I have applied to over 2,000 jobs and have at least 85 versions of my resume in my Google docs and 37 different cover letter templates. I am doing everything that I can to find a job and resources for my family. Some suggested this site to me so because I have less than 2 weeks left before I have to move and I am now desperate, I thought I would give this a try. It is my prayer that someone or some people will find it in their heart to donate to my cause. I know that there are many people in this world who are suffering now and I promise to pay it forward when I get off my feet (literally and figuratively) but these last 4 months have been HELL and I am praying for help and hope. Single mother being evicted after abusive relationship

I recently got out of an abusive relationship, physically, mentally, emotionally, and financially. He used to call me names, make me feel worthless, cheat on me, and put his hands on me, even in front of my son. There were a few times I had to call the police on him. Things had gotten so bad I grew depressed and my anxiety worsened every time I was home with him. I asked him to move out as he was no longer on the lease but he refused and the cops couldn’t make him as he was technically a squatter at the time. I ended up losing my job and having to find another one. I also ended up in a mental health hospital on a 51/50 hold because I had begun cutting my wrists. My ex stayed without paying rent for nearly a year before I was able to have him removed by filing a restraining order. He never paid what he owed me and I can’t afford to take him to small claims court. I also don’t have his new address to even file a lawsuit. Unfortunately, that left me with no money to pay my rent. It just kept piling up more and more until they served me with an Eviction. I have a 9 year old son that I am also raising. If it was just me, I’d live in my car until I got back on my feet. But I can’t do that to my son because of the bad choice I made in choosing to move in with my ex. I’m trying to raise this money within the 30 days I have before we are evicted. I have exhausted all other options including family and friends, even rental assistance options. I am also behind on my car payments, electricity bill, and insurance. I currently have a job, but every month the rent amount owed goes up and I can’t catch up with the amount I make. If I could get ahead of it, or even catch up, I know I’d be able to make my payments on time. I wish I didn’t have to come to complete strangers and ask for help but I am doing this for my son and he is the only one that matters in all of this. PLEASE HELP ME TO PAY MY OUTSTANDING RENT – LANDLORD BUSY EVICTING US

Urgent, stop my EVICTION!

I will be EVICTED on April 1, 2024 if I can’t pay $5000 for my lawyer immediately.
I am a 60 yr old man, with Dyslexia and ADHD, and have lived and worked as interior designer out of my apartment since 2013. My landlord developed dementia during Covid and his daughter took over care of his properties. My rent is very low and the daughter has been harassing me, trying to evict me so she can raise the rent significantly. I am not efficient with the use of email and for my first LTB hearing I had only 7 days notice and my PIN Code to access Tribunal Portal didn’t work. This was confirmed by a legal aid worker. Without access I couldn’t get case files or hire legal council. The LTB denied my request to adjourn hearing so I could deal with this problem. And without any evidence from landlord the LTB Ordered my Eviction. I set up Review Hearing and was denied again a proper hearing. Neither Order mentioned the faulty PIN Code. The stress of these hearings and the Covid lockdowns was affecting my work and my income was diminishing. I filed an Appeal with Divisional Court, using what funds I had left and the case was dismissed because the lawyer I hired didn’t inform me of the proceedings schedule. Then a Sherif Vacate order was sent for April 1st. With just a few weeks to find another lawyer and the costs increasing a new Appeal was filed. But my lawyer requires $5000 to perfect the Appeal in the next few days. I can not afford to move and the stress has caused me serious emotional and physical damage and depression. My case against the LTB and my landlord’s daughter is very good. Please help or my fate is dim only because of a lack of funds. Their is no Justice in that. PayPal @ChristianSPare

Help for single mom

Hello and thank you for taking time to read.
I am a single momma of 4. I am struggling to make ends meet after my childrens father passed away and just need a little help to get my head above water.
We are quickly facing eviction and I have exhausted all resources for assistance.

Mom of 3 EVICTION ASSISTANCE Emergency money

I appreciate the time you have taken to read my donation request. I was a caregiver to my father for many years and he fell ill this last year and passed away in the fall of 2023. It has been extremely difficult mentally and emotionally to get back on my feet. I am a single mother of three children ages 9, 12 and 14. A home to lay our heads, and make a difference as a family of 10!

Seriously seeking a 5 bedroom , 3 bath house to move our very large family too. After living in a beautiful and safe community for almost 8 years, where we got a chance to partially raise our family, we have been notified that we only have a short time left. It was brought to our attention that we only have till April 9th, 2024 to relocate.

Challenging Times…

Hi My name is Kimberly, It has been a journey this past year. My brother had a stroke in 2022, Dec 26. My journey has been literally a dose of ups, downs and twists coupled with drama from family. I started out in February leaving Loma Linda Hospital with my brother in the car… My first challenge because he was suppose to have a medical transport, my brother whos name is Rodney was paralyzed on his entire left side, both his leg and arm are currently being rehabilitated. I have quit my job of 25 years and closed my therapy practice to stay with him and make sure he gets good care. Without any knowledge of being a caretaker, I jumped in head first and I have not looked back. I coordinate his multiple therapies, doctor appointments and engage alongside his caretakers in his daily care (I do not get paid). I have fallen behind in all my personal bills, and struggle to make car payments and pay my rent. I loaned a friend a large amount of money 3 years ago and she has not paid me back. I am asking for anything to help with the financial challenge I am experiencing. Thank you in advance… I have never done anything like this before but I figured what could it hurt. Single mother struggling

My name is Brie. I am a single mother of 2 girls. I do not get financial help of any kind nor do I get child support. Yes I have filed for child support, but their father doesn’t have a job or he doesn’t have a job that reports pay because the child support office is looking for him. I am in a very tight spot right now I have eviction court on Wednesday. I do NOT have anywhere to go and I can’t bring my girls to a homeless shelter awful things happen there. Eviction Help !!

Hello, My name is Cindy. I am a single mother of one child. I have battled with pain for a long time since two falls I suffered one in 2013 and one in 2017. I have since been diagnosed with a herniated disk and arthritis resulting in having my nerves burnt twice and several injections. I had to go out for spinal stimulator surgery with no short-term disability at my full-time job. I have been out for 4 weeks without pay. I was behind on car payment, house payment,electric,phone shut temporarily suspended. I have gone to every agency in my state and no funds available churches tapped out in funds including my own. I have a part time and a full-time job and still having issues trying to get caught up and not enough time. I am praying for a miracle right now. I have since been able to negotiate to save my car thank the Lord, and my phone was able to be turned back on. My electric paid. I just have my rent due now $2,750.00 is due next week on Thursday. I was not even able to file an appeal at court with all of the money required. My son is currently trying for the 5th time to obtain SSD for a fall down the same steps where he received a concussion and is also on pain medications.  I have gone on y tube to apply for extra income and that is not working out. URGENT!! Facing Eviction Please Assist!

I am Elizabeth, a single mother of one who has been battling some serious health issues this past year, causing me to miss a significant amount of work. Now I am facing eviction. Currently, my 9-5 job is my only source of income, and the time missed from work has resulted in extremely small paychecks that has not allowed me to keep up with rent and other bills. I cannot even afford the medical treatment I need to prevent me from missing work because my medical insurance will not cover certain specialists. I have tried everything I can think of to get some sort of financial relief such as begging friends and family for donations, applying for loans and other credit cards, starting a business (which failed miserably), and even seeking grants from medical foundations, but to no avail. Also, I have attempted to do delivery/odd jobs on the side, but my conditions prevent me from earning a decent income from them. At this moment, I am behind in rent 2 months, about to be 3, and just received a seven-day eviction notice. My 19-year-old son who is in college that I care for 100%, and myself, will not have anywhere to go if I cannot come up with the funds owed in rent. In addition, I have unpaid medical bills, disconnection notices for utilities, car note/insurance/repairs from a hit and run accident (not my fault currently under investigation), student loans, my son’s college fees, as well as other debt. The list could go on and on. I know so many people are struggling right now, as I am a person who always tries to give back to those in need however and whenever I can. Unfortunately, I am a person in need right now and as embarrassed as I am to resort to asking here for assistance, I feel I am out of options, and have exhausted all possible efforts otherwise. Please assist me with some financial breathing room. $6,500 will help me pay off the rent I owe plus an extra month, as well as some expenses listed above. Any leftover funds after the urgent expenses will also assist me in starting medical treatment for a recently diagnosed rare condition which I have to pay out of pocket for. Eviction imminent

Hello everyone. My name is Jacqueline Bridges. I am currently behind on my March rent. It was supposed to be paid by the 5th. Honestly,  I have been behind since January.  My husband and I pay it late and then it hits again. We needed to get our car payment current and that’s what happened to some of our rent money. We moved in last July. My husband, my dad and our 2 sons. The bills were to be handled by my husband, dad and myself. After moving in on the 18th, my dad suddenly passed on the 31st. I acquired 2 more jobs after that to help pay the bills. I then became sick in December and was out of work for 3 weeks. I could only return due to my health to one of the three jobs I had. This is what got us behind. Our lease is up in July and then we will find some place we can afford. We just don’t want to be put out on the street so close to the end of our lease.  This could cause issues with us getting somewhere new to go. Help if you can. Thank you so much.
