When you sign a lease agreement, you do not intend to break it. However things can happen, Health problems can keep you from work, you can lose your job, or unexpected finances come up. The result is that you cannot pay rent. You may also want to break a lease to get out from underneath a bad landlord. Or to get away from a neighbor. It may not be expected, but there can be times when breaking a lease is necessary.

Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.

Here are six important tips to protect yourself should you face an eviction.

  • Know the laws

Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.

Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

  • Keep records

From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.

It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

  • Consult with an attorney

It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

  • Go to the hearing

You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.

Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

  • Handling an eviction

In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

  • Getting another place

Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.

Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.

Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.

An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.

Eviction Notice to be out on 31st

I can’t explain the feelings I’m going through of receiving this 7 day eviction notice. I’ve never been in this situation and it’s hard to function. My 6 yr old daughter and I moved in with my significant other after a horrible divorce, fight for custody and 3 restarting orders later, my partner took us in for safety. We worked in the same company for 7 yrs and he was very high up in his position and asked if he can share it with me after telling me he’s fallen in love with me since he first saw me. He lost his job as our company got sold and changes began of eliminating everyone with high seniority. Im the only provider now and fell behind on rent by $3000 to be able to keep up with car payment and all bills to keep living. My daughter’s school is just 5 min away walking and she finally feels like she’s stable and I promised I will never leave her side since shes been through so much distress from the past from the divorce. Her father abandoned and decided to quit being involved and said it’s too much, now he’s in prison after a yr of being MIA, for attempted m*** on his last ex girlfriend. We are to be moved out by 3/31, and that’s 1 day after my birthday. I stumbled upon this site and decided to put my story out there to see if maybe a miracle would happen and that person out there could feel my pain and heart ache and help. Thank you for reading.

Single mother with 5 month old baby

Hello,

I am writing today because I have been having ongoing issues with the landlord has been ruthless in due to late rental payments. My ex-husband left the week after the birth of our daughter. Its been a challenge to make ends meet. I’m seeking help now because the landlord has been trying to evict us from the unit due to 3 months back rent. He has had multiple personalities some days he says we can work on paying the rent and then days like now where he is threatening to call the sheriff if we don’t leave by March 25th. In dire need of HELP

Hello. I’m a single mother of two struggling to keep my home. I work overnight and use Uber everyday to get to and from work.  This takes half of my paycheck monthly.  I’m struggling to provide for my family (children 16 and 3). Eviction Notice please read my story!

 

My daughter and I moved from Colorado to Florida. After arriving in Florida, my daughter got a promising job. I was working remotely. Things were looking up. One day at work, she was walking down a flight of stairs. Her leg slipped between the steps, and she was dangling by her ankle. They rushed her to the hospital, where she underwent emergency surgery. It took her months to recover, and during that time, her car was repossessed. The stress of the situation and missing work to care for her also led to my job loss. I ended up giving her my car.

With no income and mounting medical bills, our situation was becoming increasingly dire. Late fees and emergency loans with exorbitant interest rates only added to the burden. It was at this critical juncture that my elderly mother stepped in to help. She sent us a few checks and put some bills on her card. Her support was a lifeline, and I am deeply grateful for her assistance during this challenging time.

My sister, who does well financially, visited my mom and found out she had been helping us. My sister, for reasons I still don’t fully understand, had my mom reverse any payments she had made for me. I didn’t know it happened until I was faced with phone calls and harrassment. When i got a call from my appartment complex telling me I was a criminal basically, I told them they were out of their mind! I had no idea it was real.

This left me in a dire financial situation. My apartment demanded two months of back-pay rent, utilities, and more (Due to reversed charges). My mind is spinning at this time. How could this happen? I found myself in so deep. The depression was more than I could handle. I found myself with no money and no family. I didn’t want to live!

I should not have borrowed money from my mother, but she offered, and I really needed it at the time. Criminal charges did not go anywhere because I had text messages from her telling me she wanted to help. That which threw out her case that was fueld by my sister. Those returned charges, however, destroyed me. No longer able to afford our apartment, my daughter and I went our separate ways.

My daughter moved in with her boyfriend’s family. My boyfriend moved here from Colorado his son had passed away, and he was physically injured himself. We found a small house online. I was working non stop and I was supposed to get paid well for it. I thought it would all be okay and I would be fine to take care of him.

My job did not pay me a twelve thousand dollar commission that I had earned. I worked for months for that. This added to everything and, for me, was the last straw. Now, I am behind on a pile of bills. All of these reversed charges and I am not getting paid! My phone going off continuously, and all the hours I put into the job for months, they were not going to pay me! This, along with the other financial challenges, has left me in a state of panic as I searched for another job.

My boyfriend and I told the landlord that the rent would be late. This is only our second month. The landlord showed up at the door with a three-day notice. He said, “Monday morning, I’ll be at the courthouse to have you evicted. ” He laughed and said, “Now you’ll have all of the court fees on top of everything else you owe me.” I didn’t say anything to him, I just watched him walk away, wondering when this happened to my life. Again, we have only been here a month! I stood in total shock! How could any person have this kind of luck?

I have found another job, but it could be two weeks before I get paid and I am so far in the hole. I have a packrat in Colorado that has my dad’s memorabilia in it. It is behind, so I must pay for or ship it! It is almost $400 a month to store it and $3,500 to ship it. Since we are being evicted, I won’t ship it until we know if we are homeless or not. For rent, I need almost $4k to get out of the eviction. We don’t have food. After posting this, I will have $1.93 in my account.

There is a value on everyone’s head and the value is all about how much a person has. How does the lack of money destroy the life of a hard working person? I think about homeless people I have passed on the streets. I think of times I may have rolled my eyes at someone elses lack or valued someone by what they had. Then I think…I am them now! What a lesson I have learned.

I can’t seem to find any help in the area. This is only temporary and I only need tempoarary help. I spoke with an outreach today. He said that once there is an eviction notice, they cannot help. So the question is, if the churches hang up on me or don’t respond, I have no more family. How does a person move forward without anyone or anything? I don’t even have a car. That is where I depend on the kindness of strangers. That blood curdeling cry for help in these words. I am at your mercy! Twenty dollars right now would change my life! I am fueled by the will to live without a life. I need a strangers love!

Help preventing eviction!

Hello whomever happens to stumble upon this posting. As the title suggests I am reaching out during this challenging time for much needed help. I am currently behind on rent due to becoming a single income household. I have until March 20th to come up with the amount or my family will become homeless. My family consists of myself and my four children, soon to be five as I am expecting. Trying to hold off homelessness

Hi everyone,

I never thought I’d be in a position where I’d be begging strangers for money, but here I am.

So, as my life stands I lost my articling job a year ago because I got a concussion and wasn’t able to perform my legal work accurately (which is fair enough). However since then I haven’t been able to get another position. Now I’m in a position where I have almost $120,000 of law school and undergraduate debt, and I’m 3 months overdue on rent. I have applied to find work at a bunch of local stores like McDonalds and BestBuy. But until I am able to secure those I won’t be able to earn enough money to pay my rent, at which point I will be evicted and on the streets.

I just need about $500 to make it through the month and that’s all I really need. I hope you guys can help me out avoid homelessness in this environment.

Urgent Help Needed: Eviction Imminent-Facing homelessness

Dear Kind Strangers,

I’m writing to you today with a heart full of desperation and pleading for urgent help. On Monday March 10, 2025, I will be facing the devastating reality of homelessness. After 11 years in my cherished home, a place where I found solace and built a life, I am on the verge of  losing everything. This home is not just a building; it’s ‘the sanctuary I share with my beloved  boxturle,Tootsie,who has been with me since childhood. He’s been with me through thick and thin, and now, we are in a crisis that threatens the stability of  our lives.

The truth, is  I have no one  to turn to. I have no family, no friends,  no support network. I am utterly alone.This reality makes the burden I  carry even heavier. I have  always prided myself on my independence, on being the one who offers help. I’m an artist, and while my art has provided some income , it hasn’t   been enough to overcome this current  challenge. I have  reached a point where I cannot do it alone anymore.

My situation has been exacerbated by unexpected  medical issues that forced me into early retirement. This sudden change in my circumstances has created  a financial strain that I am unable  to overcome on my own. I  need to raise $3250 by Monday March 10, 2025. This deadline is non-negotiable, and the consequences of failing to meet it are dire.

I am not accustomed to asking for help. I’ve always earned my way, lent a hand, offered support, and been a source of strength for others. Which brings happiness to me to able to help others. But now, the tables have turned, and find myself in need of the very kindness I’ve always tried to extend.

As an artist my work is a reflection of my soul. I pour my heart and spirit into every creation, hoping to bring beauty and meaning into the world.But now, the anxiety of my situation threatens to stifle my creativity, to dim the light that fuels my passion.

Tootsie, my ancient, and wise companion, has been with me through my triumphs and my  struggles, and I  can’t  bear the thought of faiIng him now. the stress of  this situation is palpable, and I can see it in his eyes. I need to provide a safe and stable environment for both of us.

I understand that asking for financial assistance is a significant  request. I do not take this lightly. I have explored every other avenue, every possible solution, but I have reached a  dead end. Emergency Financial Assistance Desperately Needed

Starting July 27th 2023 I start experiencing pain in my thoracic spine early morning at work until 3:00 p.m. when I was forced to leave work and go to the emergency room. And result four and a half months later after numerous misdiagnosis from several medical facilities and the fact not one single doctor investigated my chief complaint of thoracic spine resulted in having osteomyelitis infection causing my spine to collapse and break due to the deterioration of vertebrae from the infection. November 8th 2023 I had to undergo emergency surgery as I was becoming septic and near point of potential fatality due to the infection, resulting in severe spinal cord damage and several nerves on the left side of spinal cord having to be removed completely to the nerve root from extensive damage. Also several vertebrae in my thoracic spine from t8 down to t11 vertebrates removed and titanium cylinder in place of as well as titanium rods from my t6 vertebrae to my l1 very birth to now support my spine all this leaving me disabled and ultimately losing my job. I have sustained the best of my ability up until current and seems to be struggle is getting harder and harder. I have 2 days frlm today to pay rent and i am short some funds as well as in need of utilities assistance and i desperately need a vehicle for my fiancee to fjnd a job. I am currently trying to sell my car as I can not make the necessary repairs now due to my disability and i can’t make it to my doctor’s appointments due to loss of insurance and no vehicle. I work very hard all my life and always been employed and stable, i have never been this down and i have no family the left as i lost mom to cancer 5 yrs ago, lost my sister to suicide 3 yrs ago and my dad passed from COVID related issues two weeks after my sister’s suicide on the very morning of her birthday. I hate to ask anyone for anything but i have no one to turn to and no one to help me. My most important issues are my rent and my utilities as i have no extra money and nowhere to go if i get evicted in two days and i have have one pup and 5 kitty rescues that depend on me providing them shelter as well. I am seeking litigation for malpractice and have been turned down several times due tk the extreme difficulty of the case jn the state of Florida and even if i do get litigation it will be some time in the future which doesn’t save my home nor utilities. It brings me to tears to have to write and post this and i feel so lesser of a person in doing so as I’m not providing what is needed to sustain, and I’ve never been this down in my life. I’m man enough to and humbled enough to ask and even beg for help and will return funds and favors on e back on my feet i promise. Please Please help me, if in the event I do get evicted I’m not even physically able to lift heavy objects to even pack or move my home if i did have somewhere to go … God please answer my prayers, please help me and my fiancee and pets keep our home utilities and a working car i beg of you and the kindness in your hearts. Even if no help is offered i wish all who read and those who don’t read all the best in life and all the blessings the deserve. I close with this from my heart, please do not take life for granted. Hi! My name is Shantel. I am a hard working full time mom and an Entrepreneur in Baltimore, Maryland. Over the past few months, I have been experiencing some challenges in business revenue, which has created a major setback in my ability to cover basic living expenses for my son and I. My landlord that has been more than understanding. I have applied for several jobs to catch up on my expenses with little success. This has been a challenging time for small businesses and creatives in my area for some time now, with the change in the economy for those who support our businesses in general. It is very unlikely for me to get on a public platform to ask for help, but social services has not even been able to help financially with a lot of those struggling locally even with employment. Many of the grants that are typically available to help those in situations like myself have been exhausted. I have gone to over 12 agencies in my area who typically are able to help out with those who are in these financial situations, and all have stated that they are funds are not available and have been drained at this time. As humble as I know how, I am only asking to be caught up on my rent to avoid being set out in eviction. $4000-5000, but anything will help reach my goal. I am appreciative of any help or resources financially or otherwise that could be offered to me. I am not even asking for money to be directly made out to myself, but  donated funds can also be made out to my landlord directly. I appreciate anyone reading this that is taking the time to understand my story in my situation. 3 Days to prevent homelessness

I am 3 days from being homeless with twin teens and 2 grandchildren. I am in this situation due to back surgery and psoriasic arthritis. I recently obtained custody of two grandchildren whose father was murdered one of which has emotional issues as a result of witnessing the incident. Eviction prevention $7000

Greetings 👋🏽; I am a divorced mother of 4 children. I was married for 9 years straight out of graduating from University of Florida. Due to an extrem domestic violence from my husband ; I went into a refuge shelter with my children and divorced him . Moving forward ; I was able to keep a steady job as a nurse assistant and manager at planet fitness living check to check with four children and single with no family support . On July 28,2024 I was headed home from work when a 19 year old college student was driving under the influence of alcohol and drugs ran a red light and crashed into my car and left me spinning out of control crashing into a light pole causing a concussion, broke knee cap , sprain ankle and arm along with whiplash in my neck and disk 4 back dislocation; also I dislocated my jaw and my Invisalign retainer was stuck in my mouth . Unable to work ; I fell behind on my bills . My rent is $1900 , utilities is about $250, my car was totaled and the young lady although arrested on site for DUI ; she had no insurance and with all of my injuries and recovery I barely have anything left over from Morgan & Morgan (my insurance was State Farm) . I just need help with my past due amount . Moving forward I have been on job interviews for 2 weeks now since I have finally been cleared to go back to work but unfortunately I have received my 3 day eviction notice . Veteran Family Facing Eviction

Since then, I have been blessed by the grace and patience of my landlord, Mr. Nick Harris, who has worked with me through these difficulties. However, the financial burden has become overwhelming, and I now owe $7,101 in rent and $2,021 in overdue utilities.

I am humbly asking for your support to cover these critical expenses so that I can stabilize my living situation, maintain my relationship with my daughter, and focus on rebuilding my life. With your assistance, I would have the opportunity to remain in my home, seek employment, and work toward regaining financial independence.
