When you sign a lease agreement, you do not intend to break it. However things can happen, Health problems can keep you from work, you can lose your job, or unexpected finances come up. The result is that you cannot pay rent. You may also want to break a lease to get out from underneath a bad landlord. Or to get away from a neighbor. It may not be expected, but there can be times when breaking a lease is necessary.

Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.

Here are six important tips to protect yourself should you face an eviction.

  • Know the laws

Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.

Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

  • Keep records

From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.

It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

  • Consult with an attorney

It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

  • Go to the hearing

You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.

Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

  • Handling an eviction

In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

  • Getting another place

Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.

Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.

Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.

An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.

Single mom with prosthetic leg chronic infection needs help

Hi I have tried every gov link phone number for help. When had rent help I was told I wasn’t eligible when I found out when it was ending I was actually eligible and why they had the program to late funds ran out. I worked causing severe injury to my prosthetic leg and chronic blood and bone infections. The guy I worked for was great I did body work and painting heavy equipment for him to resell. He fell I’ll I was then told I would get commissions for anything I sold over the lowest selling price. Well I sold more than ever expected equaling over 42 k in commissions. The owner passed away and his partner not only told me I wasn’t getting the commissions I’m owed but never even paid me for the last month of work I did. Mind you I was never paid any of the hrs I worked 24 straight or past the regular time. My electric is off my gas is off I’m about to lose my place as can’t pay my 2000 rent due to all of this and whenever I am in the hospital there is nothing at all coming in. I am not looking to get rich I just want to be able to get caught up so I can stay caught up and not keep getting further behind with the late fees and chasing money I’m apparently never going to get. To make things worse I had a lady just happened to meet crying to me how her father passed and she was left houses that needed work so she could sell them and can’t find food reliable workers. I told her I know how to paint and do things like that. She immediately asks me to scrape her house and paint it all by hand. I agreed she told me I’d get $20 an hour. I showed up the first day worked my butt off with a razor scraping the old paint. She shows up and claims forgot the money at home to pay me. I say I no big deal tomorrow is fine. I show up again work she never shows. I then get a million text I lost my debit card this happened that happened. So now she says I am trying to borrow money to pay you until straightened out. So stupid me shows up a 3rd day boiling in the sun she never shows again. Then at midnight again tons of texts how she is broke and needs to know how many hrs I’m going to work that wk how long to do entire house. So now by this point I’m realizing why nobody she hires stays because she isn’t paying anyone. So yet again do hard physical labor on my leg to get absolutely nothing for it. If anyone could please see it in their heart to please help me and my daughter if local to me I will even work it off doing yard work anything will shovel pool if that’s what it takes. I hate that I even have to ask but I just don’t know what else to do and it seems Everytime I think I have a good opportunity it’s someone else lying using me for free.

Savings was stolen

Please find it in your heart to help my family & I. Last summer my mom & sister passed away 6 wks apart ever since then my family has been in constant struggle. I am on disability and have been for yrs. My savings that my family and I had saved to move into a bigger home(new grandbaby 3 months old in the house) was stolen from my bank acct. Identity theft activity, my bank won’t give it back pending investigation. Well today my landlord tells me we have 10 days to get out he is selling the house we have been renting for 10 yrs. New single mom need help

Hello,  this is far from what I ever imagined me needing to do. I am a newly single mom, I have an 8 year old son and a 15 year old daughter, I was married for 14 years, Ive been a stay at home mom for a year and a half.  I am currently looking for work and have really good leads, however, my soon to be ex-husband recently left us and I found out he hadn’t paid our rent in 3 months or our utilities, my landlord finally reached out to me and said that he was about to give us an eviction notice, after explaining my circumstance, he is giving me 3 weeks to come up with the last 3 months rent. I am asking for any and all help, I’ve never been in this situation and I’ve always made a way for myself, I’ve never needed assistance and I am a really hard worker, but I just cannot come up with what is needed to stay in our home or find a new one at that.  There are waiting periods for assistance which I just don’t have the time to wait on as of now, since we only have 3 weeks.  I would appreciate it and would definitely pay it forward in the future.

Homeless at 70

Hello I don’t know where to start. I’ve always worked all my life and very independent. But you never know what might happen to you. Around 2010 something happened to my knee and had a hard time getting around. In 2014 had a knee replacement, went through therapy and everything I was suppose to do but it didn’t take and I have been in a wheelchair ever since. I owned a mobile home that someone gave me and I had remodeled it nicely. But it was on a rented lot. And the owner of the lot decided to sell his properties and I needed to move the mobile home. I couldn’t. I had no money to do so. I tried to sell it with no luck. So I was evicted. Put out on the street with no where to go and I couldn’t walk. I was at a store and was talking to this lady and she felt sorry for me and she told me about an abandoned trailer and she took me over there and I have been sort of staying in it. It’s not worth living in but I don’t know what to do.  I’m hoping someone will read this and have it in their heart to help. I need just something to maybe buy a small used mobile home.

EVICTION NOTICE – MY HOME SINCE 1971

Like real stories by other people here,I have fallen upon dark times.My wife and I are in our senior years and never thought something like this would happen to us.

DIVORCED MOM WITH 3 KIDS UP FOR EVICTION

I am asking for assistance with 2000 dollars because I found myself thrown in the middle of unexpected challenges, testing my resilience and strength. I am a divorced single mother of three small children, that has to navigate through the turbulent waters of raising a family alone while dealing with the aftermath of a narcissistic marriage that has proven to be particularly daunting.

Escaping the clutches of a narcissistic partner was not only an act of self-preservation but also a necessity for the well-being of my children. Till date i am still dealing with the repercussions of that decision reverberate long after the divorce papers are signed.

As the sole provider for my three children, every day presents a new set of challenges. From juggling multiple jobs to make ends meet to ensuring that my children have the emotional support they need and the weight of responsibility never seems to lighten. Despite my best efforts, the specter of financial instability looms large, threatening to upend our fragile existence.

Receiving an eviction letter is a gut-wrenching blow that has left me weak. In a society that often overlooks the struggles of single mothers, I find myself teetering on the edge of despair, unsure of where to turn for help hence i am here asking for your help.

Even though all of you are strangers but through your kindness and your support, I might discover that I am not alone in my struggles. With humility and courage, I am reaching out, swallowing my pride and asking for your help. And in doing so, I realize that strength is not measured by the ability to bear burdens alone but by the willingness to lean on others in times of need.

Help with my rent please

I lost my job two months ago, I’ve been trying to find another one and no luck so far… I’m out of savings now and behind in my lot rent. I own my trailer but live in a trailer park- lot is over due and now I am facing losing my home to the trailer park for my back lot rent! My trailer is worth so much more than the stupid lot rent.  I am getting older and now I find it harder to find a job. My health is not the greatest either. I have tried working with Dept of Human services to help me pay my lot rent but was denied due to the lack of proof to pay it going foward….. I do not usually do this, I have never asked for help before, but I find it necessary this time – actually critical. I have no one who can help me: what little family I have left is tapped out also.  I am tired, mentally, trying to figure out how to stay afloat til I get a job…. every little bit will help…

Emergency – facing eviction!

Hello friends,

I’m ashamed and embarrassed to have to be reaching out to strangers for assistance but here I am.

I have been out of work for 3 months and have spent my last dollar of savings last month.  I have finally found a job that will cover my expenses and rent but won’t be paid until the end of June.

My rent of $2750 is due by 6/5/24 and I’m hoping that the community at large will be able to fund 2 months of rent while I get back on my feet.

Lost Child after giving birth, missed work, getting evicted

Whoever seems to come across this, I just want to thank you for even being here and considering helping someone you dont know. This year has been really heartbreaking and draining for me. I have worked all my life and found myself fighting for my life and my child’s life. I followed all the doctors order, I missed so much work. I fell behind on everything but I just knew it would all be worth it in the end. I suffered for 9 months. In and out of the hospital,  bed rest, my entire body itching uncontrollably.  I just kept pushing forward. I reached the end and I was just so ready for to my baby girl. I was so ready and excited. I woke up in the middle of the night in labor. I dont have a support system so I drove myself to the hospital but something wasn’t right. I was losing fluids non stop. I get to the hospital and they push me to the side for almost an hour. The doctor finally comes, I deliver naturally but I dont hear a cry. Then 4-5 more doctors rush in, they tell me my baby is having a hard time breathing and she has to be flown to children’s, she never makes it to children’s. No one can tell me why I dont have a child and I am completely lost. I am trying to move forward but it is so hard. I’ve returned to work but now I’m 2 months behind in my rent totalling over $4000, my internet I need for work is soon going to be disconnected and I lost my only means of transportation because I was told I couldn’t leave the hospital until my blood sugar was normal. Now I have eviction court in exactly 6 days and have no way of turning this around. This has just been a nightmare and I want to just wake up. I am just really hoping that someone can somehow find this message and help me. I just want to at least get caught up on my Bill’s so I can have some sense of peace. I am a hardworking woman and never imagined I’d be here. I’ve helped so many people in my life to only find I have no one to help me. Family In Need Of Help To Pay Rent

First thing I want to say is thank you for taking the time to read this,

Hi, my name is Glen Brown, and I am writing this because I am in desperate need of help…. I have a family a wife and 3 kids, in March I lost my job and for the life of me I could not find another one until the beginning may….

I got a security guard job that saved my life because I did not know what my next move was going to be….

Please help a family facing multiple setbacks

Hello! My name is Lyla and my family and I are in need of some help. After my mom died last year, it’s been hard for us financially and mentally. Then in January I lost my job. In February I had to euthanize my cat and my boyfriend lost his job. We finally have jobs! But our car broke down. We are behind in our rent from being unemployed, but are making payment. On top of all of that, my son was diagnosed with type 1 diabetes and my sister (who I take care of) broke her ankle. Her surgery is tomorrow 5/22. I’m stress out!!!

I recently had a nerve condition that totally took my nerve out of my foot! I tryed doing DoorDash or any thing to bring in money for day to day life! But that no more than a $100 bucks on days sometimes not even close, with me being out of work and can’t stand on feet to work a real job! My 75 year old Mom is being evicted in 6 days with no money to move

Hello,

My mother who is in Virginia( out of state from me) has just told me she lost in court and will be evicted if she doesn’t pay 6000 in the next 6 days to pay back rent. She has no moving money and has worked with the city of Arlington.Va on a housing grant that will help her to cover the amount she hasn’t been able to pay (moving forward) because of her limited social security income, if she comes up with the back rent, which is close to impossible but I believe in the kindness of strangers and those who want to pay it forward so I pray with all my heart this finds you!

I am an Uber driver who works long hours and can barely pay my own bills, this is why I am reaching out and literally begging for help with my mom.

Please help me from getting evicted

  • My landlord has given me until June 1st to pay $1850. I am currently in a custody battle for my son as well. He has been living with his dad and things have not been going well. Grades are dropping and influences are all around with peer pressure. He currently has four other siblings with him being the oldest he’s not getting the attention he needs. I work full time and have been looking for over a month for side work gigs such as transcriptionist jobs and customer service. All the transcription services though are not looking for English speakers. I have multiple health issues including blood clots in my lungs two different times. Im currently on about seven different medications for various health issues. Between paying for medications and having to attend doctors appointments I have been behind on paying all my rent. I now have PTO available to use for my doctors appointments and have changed positions with my current employer that allows me an opportunity to make more money. I’ll be able to pay future rent because my landlord is lowering it to $500. She just wants the back rent paid first. I don’t know what to do. I just need a little assistance to get over this hump.
