When you sign a lease agreement, you do not intend to break it. However things can happen, Health problems can keep you from work, you can lose your job, or unexpected finances come up. The result is that you cannot pay rent. You may also want to break a lease to get out from underneath a bad landlord. Or to get away from a neighbor. It may not be expected, but there can be times when breaking a lease is necessary.

Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.

Here are six important tips to protect yourself should you face an eviction.

  • Know the laws

Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.

Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

  • Keep records

From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.

It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

  • Consult with an attorney

It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

  • Go to the hearing

You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.

Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

  • Handling an eviction

In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

  • Getting another place

Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.

Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.

Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.

An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.

Three Disabled Women Two Wheelchair In Need Of One Safe Home To Live

My family and I had a house fire back in January of 2022.  We were instantly displaced and we have been displaced for over a year. We are in need of help and we are out of time to continue to stay where we are now. We recently received a five-bedroom housing voucher grant that is worth $3,346.00 per month to assist our family with rental payments. After a year of using the housing grant for rent, we can use it to buy a home.   I am writing this letter on Monday the 25th of September 2023. We have to have a place to go by October 24th because we moved into a house that didn’t pass inspection for our housing grant and the homeowner will not make the repairs that are required for our housing grant to pay. Before I get into explaining the details of our needs I would like to share some things about who we are.
I’ll start with my daughter Ashley aka Lady Bug. Ashley is 35 years old and she uses a motorized wheelchair. She was born prematurely and she has been diagnosed with cerebral palsy, epilepsy, hydrocephalus, mild moderate developmental delays, Orthopedic issues, depression, anxiety, and obesity. Recently after the house fire Ashley was diagnosed and hospitalized for blood clots. While she was hospitalized they also discovered that she had a stomach ulcer and she has been having nightmares about being locked away from me and being alone and scared. Those are some of the health issues she deals with but I would like to tell you a little bit about her personality.
Ashley has always been a caring person. She is creative and she likes to write poems and songs. She loves listening to music. She’s a music connoisseur. When she was about 15 years old she told me she wanted to start a club for people with physical and mental challenges. She said, ” Although people call me disabled I don’t like that word. She said she would rather be called or referred to as a person with modified capabilities.
Ashley was rarely able to spend time with other people with modified capabilities so then she said she wanted her own radio channel that encouraged people with modified capabilities to believe in themselves and make their dreams come true. She felt like she could reach more people and encourage them with music, inspirational conversation, and good advice.  Ashley now has a book of poetry entitled Modify Capabilities and her Lady Bug Radio channel https://urbanstarradio.com/lady-bug-radio/   We hope to soon be able to add content to her channel that supports her dreams, but for now, we are all in survival mode.
Now, about my mother, Emma. My mother is 74 years old. She has been diagnosed with congestive heart failure, kidney disease, diabetes, hypertension, and arthritis. My mom uses a wheelchair and sometimes oxygen. She moved here from Louisiana when my sister had to take a job driving trucks across the country. My mother needs someone with her 24 hours a day so she came to live with me.
 My mother and father raise my two sisters and myself and there are 9 grandchildren and 12 or more great-grands. My dad passed away in 2016 and my mom told me yesterday that she really misses him very much. A couple of days ago she had me go to YouTube and play Daddy’s favorite songs. It was emotional for all of us but I saw the pain in my mother’s face. I see the sweetness too; she needs to be comfortable and not stressed. She got to Las Vegas on December 19th, 2021 and since January 2022 after the house fire she has been hospitalized four or more times and she also had to stay in a rehab facility for a little over two weeks.  While she was there I saw that she was very sad.
Now about me, I am 55 years old. I was diagnosed with degenerative osteoarthritis in 2015 and given a motorized wheelchair. I had hip replacement surgery in December of 2017. Afterward, I’ve been able to walk without so much pain and I am thankful. I have been diagnosed with depression, anxiety, PTSD, ADHD, and insomnia. I have developed pretty good coping skills over the years but they are difficult to apply when we don’t have a stable place to live.
We had a little money saved before we moved into this house. The owner lives in Florida and he assured us that he would work with us to make sure the house would pass inspection but when he found out the cost to repair the heating and air-conditioning he refused to pay and asked us to move out. Then he filed for eviction.
We are asking for help to get money to find another place to move, fees, deposits, movers to help us move, a moving truck, and if we need a place to go before we find the right permanent place we’ll need help with that too.
We need a place to stay where we are all together with our live-in personal care provider and safe. We cannot afford to do any more rental applications when we are not approved for the home or apartment.
We need something that is wheelchair accessible and safe. We need someplace big enough for our medical equipment. We have searched for a single-story home that is large enough to accommodate our family’s needs and it has been a challenge to say the least.
We may need at least $10,000.00 Any amount you can share will be greatly appreciated.

Desperately in Need of a Blessing

Hello,

I am a single mother of 4 who has fell on hard times. I am writing this with the hope that it touches someone to help me. I am in desperate need of a financial blessing. I am currently unemployed (actually I’ve been placed on an unpaid administrative leave) and I am unable to pay rent for September and the month of October. I have received a demand for rent letter, which has to be paid by October 5th or else I will be facing eviction.

I like to take pride in the fact that I am a very independent person. I’ve been working for the past 25 years and while it hasn’t been easy I’ve been able to make it. This year unfortunately I had an accident, I fell and broke my ankle in 3 places which required surgery. I had my surgery in April and took time off of work. When it was time to return to work in June the company did not have placement for me, so I was placed on an unpaid administrative leave. Since then I have been looking for at home work, due to the fact that I am still in the healing process and can’t be on my feet for long periods of time. I have received a job offer, however the start date is pending. I was also receiving unemployment but that has been exhausted, so currently I do not have any income coming in. The amount of rent that needs to be paid for September is 1,541.69. This amount includes rent,water and late fee. This will be the same amount in October as well if paid after the 3rd. So I’m pretty much in need of 3,033.38. This covers what I’m behind for September and will take care of October as well. Any help is greatly appreciated. I’ve tried reaching out to other resources such as rental assistance programs but I have been unsuccessful. This is pretty much my last resort. I understand many people are facing challenges these days and are in need of help. I’m hoping that whoever sees this finds it in there heart to help. I am desperate and I don’t know where else to turn.

A Desperate Plea for Help: Facing Eviction, Caring for a Senior with Dementia and grandchildren.

Life has an uncanny way of throwing unexpected challenges our way, testing our resilience and strength. Today, I find myself standing at the ledge desperately seeking a lifeline to prevent the shattering of my family’s stability. With a heavy heart, I write this plea for help, pouring my emotions onto the page in the hopes that someone out there will hear my cry for help.
I am a  out of work nurse, striving to provide a secure and nurturing environment for my mother and grandchildren despite the countless obstacles life has placed in our path. Recently, my life has taken an unexpected turn, as my beloved mother, in her late 70s, has been diagnosed with dementia. Witnessing her slow decline has been both heart-wrenching and overwhelming.
In order to ensure that my mother receives the care and attention she needs, I have had to make the painful decision to leave my job. This choice, made out of love and responsibility, has had severe financial repercussions for us. Each month, we struggle to make ends meet, and the weight of unpaid bills and mounting debt is becoming unbearable.
The most pressing of these burdens is our rent payment, which stands at an overwhelming with late fees court cost and attorney fees,  $9765 for the past 2 months. Despite my best efforts, I find myself falling further behind with each passing day. The specter of eviction looms over us, threatening to strip away the only sanctuary my grandchildren have ever known. The thought of being rendered homeless fills my heart with despair, I fear for my grandchildren’s future and their ability to thrive in such tumultuous circumstances.
I have reached out to every resource available to me, seeking assistance from charitable organizations, government programs, and community initiatives. Sadly, the demand for help far outweighs the available resources, leaving us in a desperate position.
It is with a mixture of hope and vulnerability that I turn to you, dear reader, for help. I implore you to consider the impact your support could have on our lives.  All my adults life i have been a care giver at work as well as home. I never imagined i would be in such a financial crisis.
I understand that times are tough for many, and I do not take this request lightly. It is only out of sheer desperation and love for my family that I find myself laying bare our struggles in the hopes that compassionate individuals, like yourself, may be moved to lend a helping hand.

Please help us I can return the favor in your favor

I hope this letter finds you in good health and high spirits. I must admit that it is with great trepidation and a heavy heart that I reach out to you today. My purpose is to humbly share my story and request your assistance during this particularly challenging chapter of my life.

My name is BRIANBAIRD, and I find myself in a dire situation that I never anticipated. The looming threat of eviction has struck fear into the very core of my being, as my beloved children and I teeter on the brink of homelessness. The thought of uprooting their lives, tearing them away from their friends and the schools where they have just begun to settle, is almost unbearable.

The current circumstances that have led me to this point are a combination of unfortunate events and misfortunes. When our family applied for assistance from the homeless account, we believed it would provide a longer-lasting solution. Unfortunately, we were blindsided by unexpected expenses and the revelation that we owed a substantial amount in outstanding rent. The property management failed to inform us of this growing debt until it swelled to an overwhelming $15,000, trapping us in an insurmountable financial predicament.And as of now we are at a total of 19900.  I understand this this sounds crazy.

Now what I do have that I can give in return is 2 teledyne lenses model t198065 each valued at $11,325 that you can sell or donate keep but I figured donating them you could get a tax right off along with the donation of helping my family.  That would be a double tax right off.  And I’m trying to show that we’re not just trying to get something for nothing.  The lenses are top of the line IR flir and can pick up a signature on the moon as well as piping 25 ft below the ground  with a view spectrum 3 times greater than any other lense that only has 25% so this means you see everything as well as pinpoint readings and accuracy.  I would sell them myself but do not have the resources  to due to them being so unique. I have been tirelessly working towards remedying this situation. As the court hearing on the 28th approaches, my relentless efforts have yielded approximately $2,000, which I will have by the 22nd. However, it is far from enough to bring us salvation and halt the devastating aftermath that awaits us. The weight of this burden is suffocating and my spirit grows weaker by the day.

Transgender man needs help to avoid eviction in Florida

I haven’t been able to save up money since I began my transition because I’ve been thrown so many curveballs related to it.

I’ve been kicked out of the family home a year earlier than agreed because a family member was angry that they didn’t understand my transition, and that I didn’t want to answer very intimate questions about my sex life. Then the family cut me off completely (wouldn’t speak to me for 2 years) because I didn’t want to give my new address to my abusive parent who had continued the abuse when I came to stay with them when I needed help early in transition as an adult.

I had a great job where I had extra responsibility (like checking my co workers out before they were allowed to leave, and being the closer), I was full time and known as one of the top earners and hardest workers. I got fired because I responded to a cook misgendering me on purpose to insult me (he later apologized, I thought we were friends and in fact had assisted him with rides to help his family keep his home before this happened) by raising my voice at him… in a restaurant where people have thrown things at the manager and just got asked to cool down outside for a few minutes… people were constantly yelling and arguing. Over a year being there and I NEVER saw ANYONE get fired for anything like this. Everyone who saw the situation, and a civil rights lawyer, all said it was illegal discrimination. I unfortunately couldn’t handle moving forward with a lawsuit in time to do it, while finding a new job and learning it and catching up with my lost finances from the firing and the mental impact of this sudden firing when I had been a top employee and dedicated most of my time to the place. I had been fired right before I was supposed to go as a representative for my restaurant to a busy outlet mall area for Black Friday, so basically just before the holidays and I was supposed to make a ton of extra money by doing that. It was very jarring, especially because I had only been “out” less than a year so I was still getting used to being harassed and discriminated against. There was a lot of harassment, including a manager at that job, co worker at the next job, guests at my jobs, and strangers on the street and the bus and the places I hung out with my friends.

Since then, I’ve had to change jobs for discriminatory reasons multiple times. I also had to give up my second job because I was arrested for “trespassing” because a cop told me to go to the bus circle at this location and get a bus ride home and after I started going down the stairs I realized- as he was well aware already- that since I had lost my bag I had NO money for a bus ride. So I figured if I just sat down there and didn’t leave I’d get in trouble again. I thought my best course of action was to immediately report to him that I couldn’t physically follow the directions because, as he knew, I had no bus fare and ask for more instructions. I was attempting to comply.

He immediately arrested me. What followed was described by the criminal lawyer I hired as “torture” and he wanted me to submit the video to a TV lawyer to expose the cops. I want to but I am afraid. I recently contacted a lawyer that deals with civil rights for more help.

The torture ended with the cop punching me in the genitals- see, the reason they were torturing me is because my legal name is female and since I lost my bag I couldn’t give them ID and they weren’t satisfied with my truthful answer to that question, they kept asking my “real” name and I said that’s my legal name and they kept hurting me for it, I was trying to explain for the hours this arrest took that I was FTM transgender man, but they didn’t understand and assumed I was MTF trans woman who just never bothered to transition, I guess, and had a mustache and everything- trying to inflict the worst pain possible. But since I don’t have the organs he was seeking, he punched me in what I do have, and I thought I was purposely being sexually assaulted since I explained everything so many times. But yes he was trying to hit male organs because that hurts so bad. I considered myself unfortunately lucky I got punched because that’s the only way I got a female cop to inspect me. It makes me scared thinking what the male cop who assaulted me in multiple ways would have done if he were inspecting my genitals and discovered them suddenly.

Because I lost my bag and my car keys were in it, and my car had a custom type of key where you need a code from the steering column or somewhere near there to make a new one, the mechanic informed me that the steering column may not be right after he did so, but it was the only way to get a key made. I agreed in hopes I could get it to a mechanic in time to correct that. My steering column fell apart the very next time I drove it, when I was in an oil change where I intended to ask if they could fix it or direct me to someone who could.

On top of that, I was supposed to start working as a server at a high end restaurant on that property soon. Since I was trespassed for not having bus fare, I was unable to finish onboarding and lost the opportunity. The cop also tried to charge me with a felony, battery of a police officer, because he claimed when I was talking and I threw my hands up to show I didn’t understand what to do, that the soft side of my baseball cap touched him by accident (I was holding it by the hard part). Thankfully that charge was dropped, but it further solidified my point of view that this man targeted me due to his hatred of transgender women which he thought I was.

They put me in solitary confinement. I was lucky I was able to get help with bail at the time and only stayed one day and night. They stuck me in there because of an argument between the shift change of the person in charge, one said I could go in with the females- the law now, actually- and the next guy, who changed before I was thrown in there, said I couldn’t. I don’t know how I’m supposed to be any more of a threat to females than the other people in that population, but I am well aware that in the male population I would be under threat and since I’m legally female they couldn’t force me in there. I also was unable to eat, as they didn’t believe me (or didn’t care) about my food allergies.

I was able to get a new job quickly and I picked up two. I worked every single day for a couple months. Then I just worked most days, as many as I could pick up, until I was forced to choose between the two jobs so I had time to complete community service hours. I chose the higher paying job, not the one that treated me as equal as cisgender people and respected me as a whole. That backfired as I found myself being harassed at the job I chose. Just like another previous job, the managers offered to move ME to a worse location, not the harasser. In self respect I said no and continued to work there until I was able to start a new job and put in 2 weeks.

The new job was higher paying and I finally felt I was somewhere I could thrive after the last 5 years. I started doing very well mentally, moved into a new apartment which I was taking very good care of and paying rent on time, and thrived in the new position, even though it was very different from my previous jobs and I had to learn a lot. I actually studied over 40 hours on my days off to pass the evaluation. It was difficult but rewarding as I have always prided myself in being an excellent worker.

A few months in, I started having problems with co workers loudly talking in the kitchen about how trans peoples’ “lives don’t matter”, that they think we’re p*dos, that we shouldn’t be allowed in bathrooms, etc. I reported two separate instances to my manager. One of the incidents in question was done by someone who has anger problems and says violent things a lot. I was terrified of him. AND he told the other manager he knew it was me, but that manager denied it. I heard this myself.

My mental health began to deteriorate AGAIN. Soon after the first incident, Florida started churning out insane discriminatory laws against transgender people, like that we can’t use public restrooms (I look like a man so de facto I am banned from all public restrooms obviously because I’m legally required to use the womens’ but as you’ve seen earlier, people can’t grasp that I’m FTM and I would likely get assaulted again (besides the cop, I had been assaulted in public the prior year by someone whose friend was harassing me because he thought I was a lesbian with my face mask on) and would be arrested despite following the law and now I am TERRIFIED of cops and prison (I was already in treatment for PTSD symptoms stemming from childhood abuse, this made it worse)).

Our local economy is based basically solely on tourism, and tourism suffered greatly this summer due to both people avoiding Florida because of these laws, and other laws and practices against other minority groups (travel warnings have been issued by multiple organizations), and also due to the fact that it’s been SO HOT. In this record breaking summer heat, the Hibachi restaurant (ie the tables are grills) our AC broke and the company is unable to get the replacement til late this month because it’s custom built. So our business began to suffer, guests were unhappy due to no fault of my own, we never really got our expected  and badly needed summer ‘pop’.

I recently lost this job, because I released a shift for pick up and when I went to cancel (I wasn’t feeling good the night before and knew everyone needed hours badly, but then changed my mind in the morning because so did I and I thought now I could handle it) it was NOT on my schedule anymore. I figured, as this would be the only logical explanation, that someone else had already picked it up. I checked 3 times just to make sure I wasn’t missing something or there wasn’t another shift available that day. I had no choices so I stayed home. My manager told me I had still been on the roster and I lost my job. I unfortunately have to assume I had been sabatouged by a manager who didn’t want me there anymore. I KNOW I didn’t have the shift scheduled on my end. I don’t have any other explanation. And again, I was extremely hard working and dedicated, having multiple chefs come up to me and say they noticed that I was putting in extra effort and they were impressed by the way I worked.

When I lost my job I was already behind in rent due to the very very poor summer business. When I signed onto this apartment I was making more than enough, but everything changed in the summer.

I am now facing eviction this coming week. I don’t know of anyplace I have to go. I have a couple of offers from friends but not enough money to move to where they are, nor to pay the rent I would owe them anyways.

I have a therapy cat, prescribed by my former therapist (who I also lost due to budget cutbacks at the LGBT clinic I attend) and who has been with me since she was born in the house I used to rent in, and I fear even a day homeless would be impossible to keep her healthy and safe and secured. She’s my best friend right now. I don’t see anybody else on a regular basis and I think it would be very bad for her for me to abandon her as well. As for me it would be psychologically devastating, as I vowed never to lose another pet after my parents kept and refused to return my Silky Terrier after they kicked me out of their home (they had pressured me to adopt a dog for they said it would be good for me mentally, I said no because I had feared I wouldn’t be able to keep him when I moved out and they promised they would make that work for me then they kept him when I had to leave, because I could barely afford to find a place let alone one that would take him, and even when we started speaking again they refused to give him back).

I am terrified.

Every little bit will help. If I can’t avoid eviction I will use any money I can get to secure a home for myself and my cat.

If anyone can find it in their heart to donate to make the ends meet I would be unspeakably grateful.

As I mentioned, I have always been a very hard worker- I call myself a workaholic in fact- and take great pride in this. So I can promise this won’t go to waste. I will be able to start my own payments again very soon.

I just need a chance to stay here this month and get everything back to normal.

I Was Evicted & Lost Everything – Please help!

Hi, I am a 26 year old entrepreneur and photographer. I got evicted from my apartment and had just about everything I own thrown out by apartment staff, maintenance, and/or the marshals. For a few months I had been struggling with staying current with rent (sometimes catching back up then soon falling back behind) and had been communicating with my leasing office about my situation while still working to catch up. After working all day, I came home to a changed lock , so I couldn’t get inside and was forced to contact a friend about staying the night to avoid having to sleep in my car for the night. The following day I spoke with my leasing office manager again to communicate that I only needed a few more days before I could bring my account current and was informed that it was too late and I had officially been evicted. When I asked about the status of my personal belongings that were inside my unit, the manager informed me that everything I own had been either dumped in the parking lot or thrown in the dumpster. One of the many issues with that is the fact that when I went to the parking lot to retrieve my things, nothing was out there meaning everything was gone. The manager claimed that I was supposed to be home when the unit was being repossessed, however, I was never given an official notice to vacate with any information on when anyone was coming. This meant I was robbed of the opportunity to maintain possession of all of my belongings and move them into a storage unit. My apartment staff, maintenance, and/or the marshals cleared out my apartment of everything while I was gone for the day working. In addition to furniture like my bed, couch, chairs, and tables which I don’t even care to replace, they also threw out all of my clothing/shoes and expensive things like my TV ($400), MacBook ($1800), all camera equipment ($6000), kitchen appliances ($200), and the $6,000 worth of money orders I had hidden/stashed in my closet for when I made the last bit to bring my rent current. This adds up to over $14,000 worth of loss. With that, they threw away personal belongings of mine with sentimental value that can never be replaced. All I really had left was the clothes on my back, my wallet, and my car. I am devastated having experienced this. I am not sure if I can raise $14,000 as that is alot of money, but I would greatly appreciate any help to lessen the burden of this loss to facilitate me getting back on my feet and starting over from scratch.
