When you sign a lease agreement, you do not intend to break it. However things can happen, Health problems can keep you from work, you can lose your job, or unexpected finances come up. The result is that you cannot pay rent. You may also want to break a lease to get out from underneath a bad landlord. Or to get away from a neighbor. It may not be expected, but there can be times when breaking a lease is necessary.

Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.

Here are six important tips to protect yourself should you face an eviction.

  • Know the laws

Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.

Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

  • Keep records

From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.

It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

  • Consult with an attorney

It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

  • Go to the hearing

You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.

Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

  • Handling an eviction

In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

  • Getting another place

Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.

Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.

Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.

An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.

Help Needed After Help Given

Peace and blessings to whosoever have the power to help us and do so. My name is Lionell Ephraim. I am 65 years of age. My wife, who is the same age and retired, has serious health issues and we both live on fixed incomes. A few months ago we were compelled by a family emergency to move out of our small, affordable apartment in order to secure a more spacious house to provide a safe haven for her daughter (my step-daughter) and her two young grand-daughters. Because of the sensitive and fluid nature of the family emergency I choose to keep the names of my step-daughter, her husband and two children undisclosed. However, in order for you to fully understand our predicament, I think its critical to explain the details of the family emergency.

My step-daughter is in the military. In March of 2024, while she was stationed in New Hampshire, her husband, who was living here in Virginia with their two daughters (ages 2 and 8), threatened to kill himself and their two daughters during a phone call. My step-daughter immediately called the police and her mother. My wife in turn called me, because although my wife and I live about 200 miles from her daughter’s apartment, I happened to be in the area of her apartment at that time. My wife frantically informed me of the death threat against our grand-daughters and asked me to meet the police at the apartment to take custody of them and bring them back to our home with me. I quickly made it to the apartment and communicated with the police until they were finally able to gain entry, arrest the husband, and allowed me to take my grand-daughters in my arms to comfort them and bring them safely with me home to their grandmother.

In short, my step-daughter was granted leave. Understandably, she and our grand-daughters needed to live with my wife and I until she sorted things out. However, our apartment was just too small with just one bathroom to accommodate our private and personal needs. So we searched and found a larger house with two bathrooms. However, the rent ($1,400 a month) in the larger house was double the cost of our smaller apartment. But we were willing to bear the cost and uproot ourselves in order to protect our grand-daughters and give them time to heal from such a traumatic experience. Although my step-daughter was receiving military pay every two weeks she claimed she could not help us with the deposit, the rent, nor any of our bills because she needed the money to relocate. She convinced us that she would not reconcile with her husband and could not live in their previous apartment again because she feared her husband would return there after he was released from police custody.

Shockingly, we discovered that my step-daughter’s husband had been released from the psychiatric ward and she had been seeing him and spending money on hotels to be with him while living with us for almost 3 months, free of charge. We were furious that she had put us through rearranging our lives and moving into a place we could not afford just to go back to a man who had threatened the lives of her children. When I confronted her she refused to talk about it, and I realized that she had used us and was planning all along to get back with her husband and move back into the same apartment.

In the end, we spent all of our savings paying the much higher rent and bills in an effort to help my step-daughter and our grand-daughters. And she lied about her ability to help with the financial burden of moving, when we only moved to help her and our grand-daughters. Now they are back together and my wife and I are stuck in a house we can no longer afford, and are now facing eviction in 10 days if we do not come up with back rent totaling over $2,400. My step-daughter knows we are facing eviction and still offers no help. I will hold my judgment against her for now. Right now, my focus is on not becoming homeless.

Children’s Counselor and Fiance Hit Rough Patch,Personal Illness and Disability Causing Eviction

I have spent the last 15 years of my life working with children and young adults with mental health diagnoses, and those who have suffered from trauma that most could not imagine. They have taught me so much about life and what is important. It is priceless to see them make breakthroughs, however, it has never been a lucrative profession. I have struggled to make it through over the year, but we have always managed to keep our heads above water selling items on Ebay and driving for Uber. That is until the last few years. My fiance has become very sick and has not been able to work consistently for the last several years. He has had a head injury and very bad blood clots in his lower legs and lungs.

We finally applied for our dream apartment, which is rent-controlled at $1400 per month. Before COVID-19, rents in my area were closer to $700 – $800. As we are close to DC, when COVID hit everyone from those areas moved into my quaint little town ruining it for anyone who grew up here. When COVID hit, I was laid off from my job and unable to pay a credit card bill, which I thought had been written off. A few months ago, a huge garnishment was placed on my pay. This made it impossible to pay my bills. I will have to apply for bankruptcy, which is scary and frustrating. It seemed it could not get worse, but then I became ill as well. My fiance and I were both hospitalized at the same time. I was not able to save my job because of missed work, due to a lack of a credible diagnosis. We are now facing an eviction. We have one car because I hit two deer within a matter of 6 months. I don’t know the odds of this, but I have never heard of it. After I had the car fixed and paid the deductible twice, it died a month later. Our luck has been terrible. We are kind people who help others whenever possible. I do not understand this, but I know many have it much worse, so it is hard to ask for help. I am applying for new jobs and doing everything possible to make money. My fiance is just now able to work right now until they get his blood clots under control. We appreciate any help you can offer. We currently owe about $3,600 with rent and court fees. Help me prevent homelessness

The saying of when it rains it pours is very prevalent in my life right now. My 2008 van broke down, I had to have another back surgery, and now I’m facing eviction and homelessness. Hello, I am a 57 year old mother with teenage twins and recently obtained custody of two grandchildren whose father was murdered. I receive social security disability due to psoriasic arthritis and back issues and I work part-time. I recently had to have another back surgery and fell behind on my rent. I applied for state assistance and was approved until the ran out of funding. I applied for local assistance through varies Organizations but everyone keeps saying the same thing, we don’t have any funds. This is very difficult for me to ask for help because I am usually the one helping others, maybe not financially because I don’t have much but with whatever else I can do to help I try my best to do. I am desperate. I can have these kids on the street. We need $24,000 to payback rent, this months rent and fees. A Life of Challenges – Am seeking help for a new start after being fired from my job after concussion

My life has been a series from suffering, from being sexually assaulted at an early age multiple times by my uncle to facing serious domestic violence in my marriage which almost turned fatal and I had to flee the state in order to save my life as well as my children’s. In 2023  while at work I was physically assaulted by a patient and suffered a severe head concussion which made it impossible to work. Unfortunately I was fired from my job and I have been unable to secure another job ever since despite submitting several applications.

I have always prided myself of being able to provide for my children’s as well as take care of my ailing parents. Currently I feel ashamed that I can’t even pay my own bills. I have been issued an eviction notice effective end of January 2025 and I am scared of being in the street with my children. I do not own a car therefore I’ll be forced to live in the streets with them. I feel so much shame asking for help but for the sake of my kids, am pleading for your support because it will help me turn my pain into purpose.

Holiday Miracle

Hey everyone, with pain in my heart and embarrassment overall, I am asking you all for desperate help. I chose to keep my identity anonymous, to protect my children. Of course, if you reach out, I can provide you with docket number and Landlord information if you are more comfortable forwarding funds directly to them. I lost my husband and job last year and have been in arrears every month. Served Eviction notice, looking for help to secure a new place

Hello, this isn’t an easy request for me, and I’ve never been in this position before. At 52 years old, I’ve always been able to take care of my own needs throughout my working life. But now, I’m reaching out with my story, with the hope that it will lead me into a new chapter of bigger and better things.

Last summer (2023), my girlfriend, who lives with me, was let go from her job as a CNA. The company accused her of abuse at work, without any explanation or reasoning—just told her to go home. In the state where we live, this is actually allowed by law.

This event marked the start of a difficult period for us, though we managed to push through. Still, we faced many struggles and continued to fall behind. I worked for Uber for a time, using my car, and in 8 months, I took a one-year-old car with 28,000 miles on it and drove it up to 95,000 miles. In May of this year, both my girlfriend and I found stable, hourly jobs working at a group home. She works 30 hours a week, and I work 20 hours, but I also take on overtime when I can. Still, we were often late with rent. We always paid the full amount for the month, along with a $50 late fee, but the landlord eventually lost patience. In November, he chose not to renew our lease.

We now have until January 15th to move out. We are planning to relocate closer to family in Massachusetts, as we currently live in Connecticut. We’ve found a few places that we like, but the financial requirements for moving are steep. First and last month’s rent, a security deposit, and the cost of moving will amount to around $6,000.

I’ve recently started a new business venture offering sales services. It’s in the early stages, and as with anything, there’s a start-up period. The holiday season has slowed things down, but I’m confident that after the holidays, this opportunity will grow, and I’ll be able to make a solid living. So if anyone is considering helping, please know that I am resourceful, determined, and a survivor. Our main challenge right now is timing.

I had to cancel plans to visit my father and brothers in Maine for the holidays because of our financial situation. With the move, a four-day trip just wasn’t feasible.

I am a spiritual person and believe everything happens for a reason. I trust that the Universe, or God, has a plan, and that my manifestation will lead to better things ahead.

I discovered this site while searching for a side hustle, and I am praying that someone out there will hear my story and offer some support.

Help for a single mom

So how does one ask random strangers for help when they’ve never even asked the ones closest to them?

I guess for starters my name is Elizabeth I am in my early 40s and a single mom to a 24-year-old and a 15-year-old both boys. The 24-year-old is grown and married and living his own life of course all through his childhood it was me and him. We basically grew up together. At least for the first 8 years and then his brother came along. I had my up and down relationships not many as to not subject my boys to the inconsistent and immature ways of men. There are good ones out there I’m sure just none crossing my path. So I have worked two jobs majority of my adult life to provide the best that I can on my own. At least up until 2020 and covid happened. Since then I moved out to the country just me and my younger son had just went through a bad breakup with someone of 6 years who completely deceived me cheated and lied continuously. That was at the beginning of 2020 once covid came about I lost both the jobs I had and as everyone else did I’m sure, filed for unemployment and survived off of that for the next year and a half. At which point my mother who is in a wheelchair and has muscular dystrophy, had been put into the hospital. Once she was released that became my job to take care of her, be her Aid and help her. I do whatever she needs whenever she needs and I am paid hourly for doing so. But it is minimal hours minimal pay. So with the breakup with covid with losing my two jobs depression starts to set in. And then my family and friends started dying first my grandmother then few months later my grandfather and then 16 more family and friends after that up to this point even until 2 weeks ago when my best friend died of an overdose. So since the start of 2020 18 of my closest friends and family including a best friend’s child have died. Really setting my depression and anxiety into overload causing me severe mental health issues. Then we add the stress of money trying to keep up with the High Cost of Living, a teenage boy who loves basketball and wants nothing more than to play professionally or be a professional gamer. Neither of which I am able to afford. All that to say this, I just need some help to get ahead so I’m able to keep up my rent is high my car insurance is high my power bill is high and everything has gotten behind at the moment we are two weeks from the end of December and I am still trying to figure out where rent for this month is coming from. Then to add icing to the cake my car has broke down on me and I cannot afford to get that fixed at the moment either the generosity of someone or anyone is so appreciated. I’m not the type to look for handouts or ask for help. But at times everybody needs it. I’m just push your pride aside and ask for help and let people help. It may be far fetch but in order to get ahead and be able to keep up not just caught up. I would need about $5,000. Again generosity is utmost appreciated. Single Father of 4(3) about to be evicted before Christmas

 

Hello My name is Terrance and I am a dedicated father of four children, 22, 17, 9, 7 seeking assistance with my financial situation due to the events that took place over the last 15 months. It started last year when my wife of 3 years and I had an argument. We had been having marital issues for a while now and in Sep of 2023 an argument escalated into a domestic violence situation and the police were called. She was arrested and released the next day. I thought we would be able to work things out, even starting counseling. Everything seemed OK at the time, but I came home from work one day 2 months later and all her things were moved out of the house and she just left. I still have not heard from her since that time. That was hard enough to process on its own. Also around  that time my oldest daughter went missing and no one knew where to find her. That was scary because at 16 years old she was diagnosed and has suffered from schizophrenia and manic depressive disorder since. At the time she was living in San Diego with her mother who was also not aware of her whereabouts at the time. So after exhausting everything I could do in Arizona I drove to San Diego to see if I could find her. I did not find any clues or information on her whereabouts until December of 2023. She was found in jail. She got involved with people that took advantage of her mild nature which ended her up in that situation. When she was released she stayed with her mother in San Diego, until her parole could be moved to Arizona where I live. While in the process of dealing with those events, January 2024 my IT job of 5 years at Charles Schwab did away with my position so I was out of work. A few months after that while attending an event  with her mother, my daughter was at Mesa college in San Diego. At that time my daughter began having an episode where she was hearing voices. She approached her mother and was told to go outside and get some air. A couple of minutes later  there was a commotion outside where people were running outside and when her mother went to check it was our daughter…. she had jumped from the 4th floor roof, taking her life.  Her death has broken me in ways I did not know existed. Her 3 siblings brother(17), sister(9) and brother(7)  also have been having a difficult time and are not handling it very well, particularity the younger two are breaking down constantly over it. I slowly fell into a deep depression, not eating or sleeping for days. My family helped and supported me as best they could but are no longer able to assist financially. I got to the point where I was completely lost and could not function. It was difficult for me to even get out of bed since my daughter’s death, sometimes not leaving the house for days. I have used all my savings and have fallen behind in all my bills. I am just now getting to the point I can begin to pull myself back up, knowing I need to be there for my other 3 children because they still need me. I have been applying for jobs but nothing yet and as such have had to take out multiple loans just to make ends meet. I am seeking assistance with my Rent which is now 3 months behind($10,420) and am now facing eviction in Dec. In addition to scraping together for basic needs all my bills and loans are behind at this time. I am in desperate need of whatever assistance is in your heart to give to assist me so that my children and I do not end up homeless this holiday season. I am appreciative and eternally grateful for any assistance given.

Emergency assistance to avoid eviction

Good Day,

I have been living in my home for over 10 years, my son grew up here and this place holds many memories for us. In 2017 my son’s father passed away leaving me to be a single mother raising my son alone. It was devastating and traumatic for the both of us but I continued on doing the best I could. When Covid came, I was sick a few times but after this last time it has been a lingering feeling that I can’t shake. I have to see a doctor monthly and it has been affecting my ability to work a steady job to receive income. In August 2024 my car was repossed and the only way to get it back was to file a chapter 13 bankruptcy. At the time I was also behind on rent so they added the late rent to the bankruptcy. I was unable to keep my monthly payments with my bankruptcy so they dismissed reopening the debt I had initially added to the bankrupty and now I owe my rental company $7593.16 which is due immediately as I have a court date for 12/16/2024. Please help me as I have no other options.

Single mom evicted

Hello.

I’m a single mom of two boys. I work up to 60 hours a week but I cannot get out of debt, out of the box!

Due to the nature of my job, I experienced the back injury which left me unable to work for four months.

My name is Katie. I am a full time single mom of 3 amazing children (14,12 & 7). My kids dad after 16 years of being together decided one day he was going to pursue the “street life” full time which included heavy drug use. I kicked him out of our home because our kids & myself didn’t need to be exposed to his new lifestyle choices which made him homeless. For the next 3 years he made our lives literally something out of a scary movie. For 16 days straight he would break into our house at night while we were sleeping (so I thought) & steal my money (everything I had saved up in a shoe box in my closet), my car, my phone, I had to replace 17 tires during those 16 days, 11 cell phones, he would start beating me in the head & face while I was asleep (I was a bartender at the time but ended up losing my job due to calling off because of the bruises & cuts on my face). Found out he was never breaking in to my house he was actually living in my completely unfinished crawlspace & would come out at night. I ended up meeting a guy which really ticked my ex off. He tampered with my vehicle which led to me & my daughter being involved in a car wreck last Oct. My daughter suffered from a collapsed lung (which healed itself within a few hours) & a minor brain bleed. I suffered from 7 broken ribs, realigned my spine, sliced my left knee apart, major head trauma, lacerated open my spleen, collapsed lung, broke both the ulna & radius bones in my left arm in 3 separate places & bruising/lacerations all over my body. After that accident I was unable to work so all the monthly expenses were being taken care of by my boyfriend Dom so that I could heal. Dom was murdered on April 7th of this year due to being in the wrong place wrong time & a stray bullet hit him. My ex is now in a halfway house after being in prison for 1 year & is eligible to leave the halfway house in 5 months to live on his own. He had 96 charges but the DA ended up making a deal dismissing some of those charges including attempted murder. I applied for disability 8 months ago & am still waiting for it to be approved. The social security office said it could take at least a year for a decision to be made on my application.  I just got approval from my dr to return to work so I’ve been applying to literally everywhere but no luck yet. While I was healing I did start my own business called Caprimini LLC which will be a spiritual spa for holistic healing but I don’t have the funds to get that really up & going. I made a professional business plan & submitted to the SBA but due to falling behind on bills over the past year my credit has suffered significantly. My kids & I are facing an eviction at this time. I owe my landlord $8,700. My car is on its last leg & it would cost more repairing it then what it’s worth so I need to get a cheap used one from a private seller. Can’t get one with monthly payments due to my credit. My kids told me to not stress out about Christmas presents because they’re just happy they still have me & they know I have to take care of the landlord before anything else. Bless their hearts but a child shouldn’t expect there to be nothing for them Christmas morning. I honestly am just trying to save our home at this time & maybe get a cheap car for now. My ex does know our current address which scares me for when he gets is approved to leave the half way house but that’s not for a few more months & I just need to focus on a roof over our heads for right now. If anyone feels it in their heart to help us I’ll have my info at the end of this post & my children & I will forever be so grateful & absolutely will pay it forward once we’re back on our feet. Single Mother

I am a single Mother with two children. I am currently going through a hardship. I work in manufacturing as an extrusion machine Operator. I had been working a physically demanding job for a while and it has taken a toll on my body. I am always in pain and rarely have energy to do anything. I recently lost this position due to leaving early to get my daughter off of the bus from school. I have been applying to other job postings and going to temp agencies for work but have been unsuccessful. I don’t have money for rent, utilities, and groceries.
