I was given a CCJ on 16 November 2021 for the amount of £6868 from Legal recoveries, representing student finance of a maintenance grant which they ‘overpaid’ me back in 2015 for my university studies.
As a consequence for not attending the court hearing, (bearing in mind I was on unemployment at this period) I was fined the above amount of £6869 with interest added on top, the original amount was £1129 of a “Grant overpayment” which I was only privy to much later when i had already spent my grant payment.
Student Finance miscalculated, the amount that they was initially going to pay me for the grant but I do recall them double checking my families overall housing income and in many cases they did triple check asking me for extra proof before they even issued the funds to me. After all that they seem to have miscalculated and overpaid me and required me to send them some of this funds back, which I wasn’t even aware of until I longer had the necessary funds to pay them back. I feel very hard done by Student finance requiring me to pay with immediate effect a portion of the money they sent to me.
Furthermore they moved this to a dept recovery, to reclaim the funds on their behalf, they harassment for months on end asking me to contact them to reach a payment plan. This at the time seemed outrageous as this was apart of student loan and these funds were not required to be paid back, unless you were earning a considerable amount after you have found work. Me trying to be civil. I agreed an agreement with them initially I was paying £200 monthly bearing in mind I was still studying and working, then I reduced this amount down to 50 then £10 monthly payment which I had lost count how much I had paid them in total fan. COVID-19 hit and unemployment came with it as well. I simply cancelled my direct debit with them; and did didn’t have any intentions of paying them anymore, fax forwarding to having them put a CCJ on me.
I have reached out to a legal advise services and they simply all have said “ I should work out a payment plan to eventually get this paid in full” at my current capacity of earning I am 30 living in social housing working two jobs and paying bills and looking after my elderly mother; I’m struggling to even make a dent on this amount.
I strongly believe I have been hard done by, so much so I have reached out to Baristas to aid me in fighting this in court if anything, I am exhausting all my options as I strongly don’t want this affecting me getting a loan in the near future due to the CCJ being under my name.
i am not the type to ask strangers online for anything, but I’ve been put in a position where I have no choice but to ask for aid anyhow I can get.
