My ex-wife got out of prison earlier this year after having been in for attempting to smuggle drugs across the Mexican border. Our marriage ended in 2005 and I had been paying her alimony up until she was put in prison for smuggling. At that time I went to court and the judge stopped the alimony for me. This was in California and I have since moved to Texas with my new wife of 10 years and our two kids. To our surprise she was released on probation late last year and took me back to court for alimony reinstatement. I pleaded my case that I had moved to Texas, have lower wages, two kids and a wife to support and do not have sufficient income to pay the $2700 dollars a month but none of that matters under California law and I was order to start paying again. I had to pay attorney fees, give up half of my retirement and 401k savings, which all those assets are frozen currently being tied up in QDRO case and pay her 6 months back pay. I have taken out personal loans, borrowed on credit cards and have been using them to pay our normal housing expenses. I have finally found a second job to help with the short fall in income but am so far in the hole I am planning on filling for bankruptcy but the attorney tells me all debts may not be forgiven since I now have two incomes. I’m also looking at foreclosure since I’m currently behind on mortgage.
