Please, I am reaching out and begging for help from anyone that can help me, my partner and our three children, ages 11, 3 and 1, with getting the money to move our home by March 12, 2021. We are being evicted and because I wasn’t able to afford to move the mobile home from the rental property by Dec. 31, 2020, my Landlord’s Estate has brought a judgement against me in the amount of $14,900 and are also trying to take our mobile home as well.
I have been renting a mobile home lot in Alabama since July 2014. The mobile home is mine. I lost my job due to health issues and due to Covid pandemic, I have struggled with paying rent on time. My landlord’s daughter in law was in charge of collecting rent. She was very patient and understanding, when I was late, due to me losing my job and due to the Covid Pandemic. My landlord developed health issues and then made his daughter Power of Attorney. She served a 7-day letter in November and I paid the amount in full on Nov. 19, 2020, before the given date. November 30, 2020, she texted me a copy of my receipt and the money order I had given her and told me that she would send me proof of address for other reasons. My rent was paid in full and not due again until Dec.1, 2020. On Dec. 1, 2020, I came home to find another paper attached to my door. It was a Notice of Non-Renewal of Renter’s Agreement, typed up by a lawyer on Nov. 30, 2020 dated Dec. 1, 2020 telling me to remove myself and my property from the rental property by Dec. 31, 2020. I called her to talk to her about the notice, but she did not answer. She texted back and told me that her lawyer was handling things and to contact him with any questions, moving forward. I called her lawyer because I was confused about why I was having to move after paying the rent in full and also, when I talked to my Landlord’s daughter on Nov.30, she did not tell me that my rental agreement was being terminated. Her lawyer wasn’t available and never returned my call.
My partner tested positive for Covid in Dec. I did develop symptoms, but wasn’t tested. Due to being exposed, I had to be guaranteed until Jan. 5, 2020. So that, too,kept us from meeting the 12/31/2020 move out date.
My landlord died Jan. 5, 2021 and an Unlawful Detainer was placed on my door Jan. 8, 2021.
I spoke with my Legal Aid Lawyer about the Eviction Moratorium. He did represent me(?). But said the Eviction Moratorium didn’t apply to my situation. I even told him that the property was listed on a realistate site, not for rent or sale, but the future site of a 200 home subdivision, thinking maybe he could find that to be the reason for the termination of my rental agreement and perhaps she would be responsible for relocations fees He said that was all irrelevant and that the land done everything the right way He said he knew the Landlord’s lawyer and all he has done is side with them telling me that it is very important that I remove my home before they take possession of it. I told him that it was a little different than packing boxes and moving and more costly. He had no idea how much it costs. I told him I was quoted $2400 to move it only 10 miles, but the company could not give me a date that it could be moved. Other companies quoted prices between $2500-$3500. The Legal Aid Lawyer also told me that there was no type of aid or help with funding to have it moved.
I went to court 2/26/2021 and, as of now, I have until March 12, 2021 to move my mobile home. If it is not moved, according to the Legal Aid Lawyer, I will have the $14,900 judgement against me, if not more, and the Estate will attempt and probably succeed in taking possession of our mobile home. I even had to provide the Landlord’s lawyer with proof of a clear title to my mobile home, the Bill of Sale and current registration. I was told by the Legal Aid Lawyer representing me if I didn’t provide the requested documents, I could be found in contempt of court.
Anyway, after paying my rent in full in November, not knowing my rental agreement was being terminated, my partner and her children moved in with me. Now, after all of the excitement of setting up the girls rooms and getting settled in together, we are all about to be homeless and I do not know how to fix this. We are in desperate need of prayers and help with coming up with the money, $2500 to $3500, because we are running out of time to move and save our home. Anything will be appreciated Thank You
