When you sign a lease agreement, you do not intend to break it. However things can happen, Health problems can keep you from work, you can lose your job, or unexpected finances come up. The result is that you cannot pay rent. You may also want to break a lease to get out from underneath a bad landlord. Or to get away from a neighbor. It may not be expected, but there can be times when breaking a lease is necessary.

Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.

Here are six important tips to protect yourself should you face an eviction.

  • Know the laws

Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.

Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

  • Keep records

From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.

It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

  • Consult with an attorney

It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

  • Go to the hearing

You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.

Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

  • Handling an eviction

In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

  • Getting another place

Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.

Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.

Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.

An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.

Rent Emergency

Hi my name is Stephanie Howard and I’m a single woman who is in NEED of help! This is new for me but I put pride aside because I just moved and I need help with 2 months rent plus fees,etc. I have a Notice to leave the premises letter which is enclosed right along with my rent portal and proof that I’m telling the truth. Total I need $2225.00 That is for June and July plus late fees and NSF fees. So in a nutshell I was supposed to be receiving help from our relief funding but to no avail. They said it was to take 6 to 8 weeks and everything I’ve submitted, etc but I’m assuming they are backed up but I personally know some others have received help and have submitted their applications after me so I don’t know what the issue is because they have said it’s in the order received. Honestly I’m not sure what the hold up is but I just don’t have it. I don’t have anyone to borrow from my credit is jacked so a personal loan is out of the question….trust me I’ve tried. I am self employed I am a hair stylist. On the contrary summertime is our slowest season why? Because it’s hot and people get like protective styles or style none because they are swimming and vactioning so they don’t get their hair done often unless they just got it like that.  So yes even though i HAD to go up on my prices this it started June 1st. But the business is just slow like I’m making booth rent just barely and so I”m really like Lord what do I do and saw a youtube video where a woman was talking about websites that help those and donate to those in need. I am looking for something to supplement my income at the moment so that I can be ahead of things but it’s just not in time for this situation. My rent is $1000/mo that’s $950 with water $50 included. If the rent portal like partial payments it would seem a little easier but they don’t especially when it’s late so I’m not going to lie I sent it through to my bank account because I felt it would buy me time and that the 513relief program would come through but they haven’t so here I am in this pickle. Single mother of 1 in need of financial help

I’m a single mother of 1. I previously worked as a nurse in the medical field. Do to an injury at work, I was place on workers compensation. It helped a little and then it was discontinued to misinformation with the agency handling my claim. I was referred to a workers compensation attorney who informed me that my benefits should not have been discontinued by law, and that it could be a few months before a trial date would be set. The doctor who was treating me for my injury did inform me that he would have to give me a referral to undergo surgery, explaining to me that it would help tremendously. I was a bit overwhelmed and taken back at the time due to the financial bind I was in with rent and bills, but agreed and just decided to replace my fear with faith. On 07/03/23 I received an email from my manager saying to please give her a call in regards to the rent that I owe. When I called she did explain to me that I owed over $14,000 in past rent and late fees and if I moved out by 07/17/23, that 100% of the balance would be forgiven and an eviction would not be placed on my credit. I was a little anxious after hearing that, but thankful because I don’t want anything to hinder my credit. I would really appreciate any financial help to get me and my little girl stable until getting back on my feet. Any financial help I receive would be a hand up and not a hand out.

Grateful for the opportunity

Hello, I am a single mother with 2 beautiful kids. I have the best of both worlds. A 14 yr old girl and a 9 yr old boy. I’ve been blessed to have been financially stabled for the last 12 yrs. After Covid hit I lost my job because my kids went to online school. For the last 2-3 years it’s been a challenge to get back on track. I’ve been late on rent. I’ve gotten help from churches, from family members and loans. I am at the point where I have no one else to ask and I am currently behind again. I have a eviction court date on Tuesday July 11, 2023. For $1500.00 and I am behind for July also. I am requesting $3000 by Monday July 10th 2023. I don’t have no place to go if evicted. Facing Eviction at 21

Hey Everyone,

My name is Liz. Currently living in North Carolina. At 18 I was kicked out Jan 11 2020. Since then I’ve had my shares of ups and downs. From being homeless, sleeping in cars/parks/shelters/ in and out of peoples homes. I never thought my life would shift like that before my eyes. I ended up moving to NC to restart and have a second chance. Things were going well. I had gotten a place with my former boyfriend. Until it all went downhill and the person I fell in love with was an abusive, toxic narcissist. I dealt with that for 2 years. And ended up moving away in December to a different area in NC so I could reclaim my life. Things were okay, I was making ends meet with my job. Until I lost my job completely almost 2 months ago. Under Eviction

Hello,

I am here because I don’t know where else to turn. I got behind on my rent due to some health issues. I was unable to pay my rent and my landlord doesn’t accept partial payments. I tried to set enough money aside so I could pay the full amount but I kept falling short of what I needed and getting further behind. When I was two months behind, my landlord filed for eviction. On June 1st, I went to the eviction hearing and I was given ten days to decide if I would appeal, pay and stay, or move out. If I vacated the premises, then no back rent was required. If I decided to appeal, I was told illness is not an acceptable defense for not paying rent. If I decided to pay and stay, then I needed to give the full amount due (both the past due and the current due) to the landlord before I was locked out by the sheriff’s department.

I stopped paying my other bills and cut down on things like food expenses to try to hold aside as much money as I could toward the rent. When I still fell short, I tried to get a personal loan to make up the difference between what I had and what I needed. I couldn’t get a loan because my credit was not good and I still wasn’t able to get caught up. So I packed up some of my stuff that I didn’t want to lose but didn’t think I would need right away and I put it into storage. I then began putting in rental applications hoping to find another rental before I was put out on the street. None of the rental applications were approved because of the same bad credit that kept me from getting a loan to pay the back rent. My landlord says if I pay the back rent and current rent I can stay here, but I still don’t have enough money to pay it. I currently have nowhere else to go if I get locked out.

It is now July 6th and I am still in the apartment but I don’t know when a sheriff might come to lock me out. It is a very stressful situation for me because I do not want to be on the streets and I am very much aware that I am running out of time here. I am working with my doctor to address my health issues. I am working with a credit counseling agency to address my poor credit. $3000.00 would pay my back rent and catch up on my utilities but any help at all would be greatly appreciated.

Please. I need help.

Sisters in need

So today I’m a coming to ask for financial help because me and my sister and her son will be homeless in a few days. Me and my sister are Domestic violence survivors, who decided to live together and make ends meet. Apart of the Domestic violence was done to her son who, was violently shook by his father at 6 months old. So he requires care and support for the remainder of his life. My wife lost her job !!!

Hello my name is Jacob Perlera. I have a wife of 4 years and we have a baby girl who just turned 1 june 29th. We have been renting in one of my mothers apartments for 4 years. My mother is selling our house to live in florida. We been planning and looking for a place for a while, however we ran out of time because  the closing of the house will be july 31rst. To make things worst, my wife’s  job informed her she has lost her position due to lack of business. So now she has no job and we have a baby and no place to live. I have been trying to find work but I cannot qualify for alot of positions because I have stage 4 kidney disease and i have already recieved a kidney transplant 18 years. I nearly got hired by the MTA in nyc for bus, and train operator  but I was denied because I could not pass the final physical due to my medical history. Its quite  a situation because between us needing to leave by the 31rst of this month and my wife loosing her job and me not being able to land a job do to my illness. We are stressed and very worried and hoping for a mircacle. Before loosing her job, we had a preapproval for a home in NC  because it is cheap out there. However since her job loss, we are no longer able to prove work for a mortgage  or now even a rental. We have money saved for a down payment, but with no work we cannot rent or buy a home. We had Hope’s Ronaldo use our savings to invest in her home country of grenada to have a home built there but we are now eating into our savings to pay bills. Basically in about 3 weeks we will be living in our minivan or in the street. I feel useless as a man because I have a wife and daughter I cannot even help due to my health. This is truely frustrating and scary. Our only option wud be for someone to help us buy a cheap house in NC for $130k. We are not people who ask for handouts. Close to Loosing everything

I have fallen on hard times I am behind on my rent due to my landlord harassing me entering my car from the property saying it makes parking when it’s not costing extra money had some money stolen from me from friends. Also, I had that line, credited friends and now I’m falling behind and my credit has been damaged. I can’t even get a loan from the bank. This is my last resort I don’t know what else to do. hello my name is ben i live with my girfriend and my 10 months old baby in an apartment in new jersey. im behind on the rent and im on the verge of eviction i signed a pay to stay agreement ive been able to make the first few payments to stay but due to extra stuff in life i will fail my lil family and get us kicked out if i dont pay the $1557 by the 07/05/23. i make about $50000 a year working in a warehouse with barely overtime. i told my girlfriend not to help finacially since i wanted her to focus on the baby as first time parents. ive been applying for side gigs but i get stop by either job not yet in my area or im on a waiting list for the next spot to open up. all i need is for you guys to buy me a lil more time for me to start my business i can no longer live check to check especially with a baby to look after i want to be a great father i know its gonna be hard but ive been educating myself on how to run a successful business but the application is in progress and i will be applying for startup funds a or loans to get going. i want to help guys like me that wanna be great fathers but dont know how to start financially. i only need enough not to get kicked out this month until my business is registered. i really want to share my baby with u guys but if my girl finds out i did this i would be in the dog house lol. we are reserve people with no social media presence on any platforms so all i can post is the pay to saty agreement…thanx in advance if my life turns around when my business kicks off i will forever remember this day i took the time to ask for help from people with good hearts i appreciate all of you.ben begging 2-1.pngben begging 2-2.png
