When you sign a lease agreement, you do not intend to break it. However things can happen, Health problems can keep you from work, you can lose your job, or unexpected finances come up. The result is that you cannot pay rent. You may also want to break a lease to get out from underneath a bad landlord. Or to get away from a neighbor. It may not be expected, but there can be times when breaking a lease is necessary.

Breaking a lease is usually grounds for eviction. The landlord or property management is not always going to consider the circumstances. Knowing your rights can help you deal with the process properly. This is useful in cases where you feel that you are being evicted unjustly.

Here are six important tips to protect yourself should you face an eviction.

  • Know the laws

Become familiar with the laws in your state. Each state has their own version of the Landlord and Tenant Act. This will serve as a guide to understanding the relationship between you and your landlord. It will contain an eviction section to focus on, but be sure to read the entire document. You can get a copy through the Attorney General’s website or by going to a local courthouse.

Pay close attention to the details regarding evictions, especially anything that constitutes an illegal eviction. In general, the landlord has to give a certain amount of notice and you have a window of time to correct the situation. Not allowing or adhering to this is a violation. An illegal eviction is not allowed in most states. If your landlord tries to evict you outside of the process, you can sue them. For example, if they change the locks on you or remove any property.

  • Keep records

From the day you move in, you should keep documents and records of all interactions with your landlord. This is beneficial should anything like an eviction come up. Keep every notice or letter they give you. Record the time, date, and nature of any verbal communications too. Always keep cashed checks and receipts as well as maintenance records.

It is also a good idea to take photos of the property when you move in, or once any grievance occurs. Some landlords have been known to claim damage to property and claim it was done by you. The more documentation and evidence you have, the better your case will be against your landlord or eviction. Not all landlords try devious tactics, but it is best to be prepared in the event they do.

  • Consult with an attorney

It helps to get legal advice during an eviction, even though you do not need representation for the case. Use a private attorney if you can afford one or check with Legal Aid for assistance. Most cities have Legal Aid offices and will be happy to provide consultation services. You get information and advice for a reduced price and sometimes free. Be sure to take all your documents and evidence so they can help you set up your case. Running through the details with them gets you prepared mentally for the case ahead.

  • Go to the hearing

You need to go to an eviction hearing in court. You cannot be evicted without this and your landlord is responsible for scheduling this. Do not miss this hearing. If you do not show, the judge automatically rules in favor of the landlord. If you go to the hearing, you may have a chance of beating the eviction. You will never know if you decide to pass. When you show up, the landlord also cannot claim damage against you or any other fines.

Make sure you are prepared before you go. Plan to proceed in the same way you discussed with your attorney. Have all documents ready to present and establish your defense before you get there. Dress professionally and arrive early.

  • Handling an eviction

In some cases, the judge will rule in favor of the landlord. Even if you have all documents and a good defense, you need to be prepared for this outcome. Make arrangements ahead of time to stay somewhere else and plant to rent a storage unit. If you have already found another rental, you do not need to worry about that. BE prepared to leave the property quickly. Every state allows an amount of time for eviction and in some cases it can be as little as 48 hours.

  • Getting another place

Evictions can be reported to credit bureaus. This can hurt your chances of renting again. Most landlords do not report this but there are other ways credit companies can get this info. There are companies that collect information and sell it to prospective landlords.

Be prepared for your next landlord to know about the eviction. Don’t plan on hiding it. Explain the circumstances to them and be honest. You can present all the same documents you had for the hearing to make your case. It does not do any good to talk bad about the previous landlord, especially if the eviction was your fault. You do not want to appear like a problem tenant. It can take time to find a new rental.

Many will turn you down, but someone will approve of you. You should expect that when you are approved you will have to pay or a higher security deposit. The eviction becomes less relevant as time passes, especially when you begin to make on-time payments.

An eviction can seem disastrous and cause for worry. The important thing to remember is that you are not the only one to go through this. Many renters have been evicted and get through the process just fine. Protect yourself by following the laws and being honest. Be prepared and know your rights and you will have the best chance of beating an eviction. If you do get evicted, know that it is not the end of the world. With time, everything will be right again.

Save me from eviction

I’m facing a rather dire financial situation right now. Although I’ve had some improvements in my life recently, I received an eviction notice yesterday, which has put into a panic about where I’m going to live. I’ve been homeless before, which ended up impacted my health in ways that I still haven’t fully recovered from. Having a stable roof over my head has been one of the single biggest factors in recovering my health. I know that becoming homeless again would end up becoming a death sentence for me. My request for emergency financial assistance was denied. I also don’t have family I can turn to. The irony is that I just landed a job doing online work as an English tutor. The conditions of the work require a quiet, distraction-free environment with internet and electricity. The thing that pains me the most about this, is that I promised my kitty that I would always take care of him. He’s ended up being my emotional support when I’ve had some of the worst days of my life. If it wasn’t for him, I wouldn’t be here right now. More than anything, I want keep my promise to him. Please Help Us Survive Eviction!!

Hello Everyone,

This is something I have never done before, this is very personal. I have never requested for help financially. But, this year has been very hard for my family. Our rent got behind because our water bill is over $1000 because of a big water leak, high electricity bill, grocery and basic needs for the household is high, car tires were falling apart; so we had to replace them so I could get to work. My landlord disappeared

For half a decade, my three children and I have called our modest apartment in Columbia, MD, our sanctuary. It has been our little haven, a place where we’ve laughed, cried, and shared cherished memories together. But fate had different plans, and our tranquility was shattered by the presence of a landlord who seemed to embrace the shadows, engaging in shady dealings that left us feeling vulnerable and distressed.

As if a malevolent magician, our landlord’s most callous act was yet to come. Around a year ago, he vanished from our lives without a trace, leaving us bewildered and abandoned. It was as if he fell off the face of the earth, leaving behind a trail of uncertainty and anxiety. Unable to grapple with the situation, we found ourselves facing an imminent threat to our home.

The heartache deepened as the bank took hold of our apartment, putting it up for auction in April of this year. The walls that once sheltered our laughter now felt like they were closing in on us, and the familiar corners now carried a sense of impending loss. A new chapter was forced upon us as new owners emerged, strangers who held the keys to our fate. They granted us a meager extension until the end of July to uproot our lives and start anew.

As a parent, my greatest wish is to provide a stable and loving environment for my children. However, life has dealt us a harsh blow, and I’ve been grappling with unemployment for the past six months. The mere thought of it ending soon fills my heart with fear and uncertainty. Despite my relentless efforts to secure employment, the job market has remained unforgiving, leaving me disheartened and struggling to find my footing.

In these uncertain times, I can’t help but wonder how we will find our way to a new home, a place where we can rebuild our lives. The mere thought of uprooting my children from the familiar surroundings they’ve known for years weighs heavily on my mind, making it difficult to think beyond the present moment.

Hopelessness threatens to consume me as I’ve yet to embark on the daunting task of searching for a new place. The financial burden of first month’s rent and a security deposit looms like an insurmountable wall. The prospect of not having a roof over our heads sends chills down my spine.

In this vulnerable state, I’m humbled to reach out to the compassionate hearts that may hear our plea. I pray that empathy will transcend the distance that separates us, and that kind souls might lend us a helping hand. Struggling single mom, taking care of sick mother

To whom it may concern;

My name is Samantha I’m a single mother of two teenager and a young child. I recently have fallen into unfortunate circumstances. I don’t receive any government assistance because according to the government where I live, I make too much money.  I make over $13 an hour. I work hard I’m a full-time student and I am taking care of my mother who is legally blind dialysis patient who just had two heart attacks. Due to the fact that I was there for my mother when she was in the hospital I missed work. Because of  being there for my mother I have fallen behind my bills. I have tried to get emergency assistance, but I’m told that on average I make enough typically I don’t have a problem paying my bills however, at this point, I really need help. Currently I am in jeopardy of losing my home. My car my utilities have been turned off in my job. I work from home so that I can take care of my mother and my children. I’m doing the best that I can to stay above water however, right now I feel like I’m drowning in bills. To top it all off my birthday Sunday and I may end up losing my home before the first of the month which is only seven days later please help. Generally I wouldn’t ask for help but I really really need help right now. I’ve never done anything like this in my life, but desperate times call for desperate measures. Please help

My name is Sonya and I am currently in a 3 day pay in full or vacate. I recently moved in to my own place from a homeless shelter. I am employed for 3yrs and I became homeless due to a abusive relationship that I left. I was trying to be independent and I don’t want to be on the street i just need a little help with the outstanding amount. I am a good person i just cant afford the repairs of my vehicle and rent.
If I didn’t repair my car I wouldn’t have gotten to work. I was only able to fix what was the major issues and still have to have more work done.
In order to make it drivable i had to choose to pay rent or car. Im to old to have to be homeless and I am not trying to go back to the abuse.

I am Terrified we will be Homeless

I am writing this plea to ask for your help in raising funds to purchase a fifth wheel. I am a 55-year-old grandmother with a dog who has cerebellar hypoplasia. I have rented my current house for six years, but I have to move out, Aug. 31st because the landlord wants more money and can’t raise the rent to the amount he wants with me in it. The rent that people are charging has become staggering. The rent for a bachelor suite apartment  has come to the point that even if I use my entire monthly income, it is too high for me to afford on my disability check. My whole check won’t be enough…I am terrified of the thought of ending up on the streets, homeless.

Even more heart wrenching is the fact that, I am a good tenant. I always pay my rent and look after the yards and homes as though they were my own. Yet, without fail, around the 5 – 6 year point, for one reason or another, I’m required to move. I am finding the stress of it this time to be almost unbearable. I am honestly not one who asks for help, ever. I am not even sure how I found myself here but, I truly believe I need to ask for help this time.                                          .

I am hoping to raise enough money to purchase a fifth wheel so that I can have a place to live that no one can kick me out of and put it on a spot that is affordable and comfortable. The rent on a RV spot is manageable and within my means. I am not an outlandish or greedy person and truly don’t require or expect a lot. I’m just asking for a place for myself and my dog Honey where we can live without fear and can finally be home for good. I have been looking at used fifth wheels up to just $10,000 and there are some very nice ones . I know that this is still a lot of money, but I am hoping that you can find it in your hearts to help me raise the funds that Honey and I need to secure us in our future..

I need help to stop my Eviction.

I’m asking for help please, I went to court on the 12th and we have till the 26th to leave or pay 5000. This is hard and I have no where to go or no one to help. I’m living with my wife and her grandchild. We had her since she was born. I really want to put her in school but with this going on she might being school late. Plus my wife has a rare muscle disease she been sick since 2008 she had cancer around that time to, thing have been ruff. It’s just been hard trying to take care of everything when this bad luck of everything I touch goes sour, work hard and something off rail happens and nothing ever works out. I lost my job a few weeks ago so my plain of putting my money together is out the question.

I have a shop that I rent to sell shirt but I owe the landlord their as well 5000. But he said if I don’t pay he going to take all of my equipment and lock it in a storage. I learned how hard it is to run a seasonal business the hard way.

Lastly It’s been so bad that my tag to my car is expired so I’m have problems doordashing and all the other services. I got 3 tickets I can’t catch a break. Recently  I just got InTouch with my father for the first time since right before covid. He is in another state and the hospital calls me constantly to pick him up I have nowhere to go and don’t how I can being him back he can’t walk and has dementia I don’t know what to do. Any help is appreciated I’m so lost right now. I don’t think a shovel can dig me out of this hole.

Please Help Prevent my Eviction so I can finish Nursing School!!

Hi. I come here because honestly I have exhausted every option that I know that I could possibly use for help and this is a last resort. Where do I begin? I recently started pursuing Nursing school and because I don’t qualify for much aid I am paying most of my tuition out of pocket.

Shortly after I began, my 68 year old mom was diagnosed with Breast cancer.  I was my mom’s main support so I took her to every appointment,  her surgery and all of her radiation appointments until she was finally rid of the cancer.  I picked up two jobs after so that I could continue to pay for school and help my mom pay her hospital bills.  I was holding on by a thread, but I was holding on until I missesd my car payment for 3 months and it was repossessed. I needed my car to get to school and work so I had to max out my credit card $1200 to get it out.  This ended up causing me to be unable to pay my rent at the time.  Soon after, I ended up getting laid off from my second job and only had once source of income. I started to Uber to try and alleviate my debt, but then my air conditioner when out in the middle of the longest heat wave on record, so I am unable to drive people because its between 90-110 degrees. I can now only do food delivery while driving around in 98 degree weather and that isn’t making enough.  I have continued to work my first job, but between paying for school and trying to keep up with basic needs, everything has gotten tight.  Meanwhile it seems like everything around me is breaking down. I am in the process of getting a new job, but then literally two days after my birthday (all of this was happening along with my bday coming up) I received this notice on my door. I now have to come up with $3100 by July 19th so that I’m not evicted.

I know I have a few issues going on, but I’m only asking to help me from losing my home.  I’m only a few months away from finishing Nursing school.  I just need to be able to finish school so I can finally start a career that would allow me to take care of myself and my family and to finally have some stability.  Any amount would helps. Facining eviction on 7/18 and just starting working after 6 months out of full time work

Good evening. I am a mom with 2 daughters ages 16 and 13 at home. I received an eviction notice to go to court on July 18th. I have until 2 pm cst 7-18-23 to get 3435.00 paid so we do not lose our rent home. Here is my situation.  In October 2022 my husband of 18 years left us. I lost my job in December. I left my job that i was at to start at ups. I went to orientation at ups the day i left my job. They never scheduled me to work so then i was jobless. I sold the only thing of financial value we had to pay rent. It was a 40 year old pontoon boat but it did pay 3 months rent. I started substitute teaching for 80 per day. I picked this job as it is close to the house and i could walk.  I am still without a vehicle but i do walk home from work as you do what you need to do. I started working at a job for 15.50 an hour that started 7-1-23. I am very thankful for this job as it will help keep us where we can keep a roof over our head and basic necessities. Single mother of two beautiful toddlers, facing a distressing situation

I am a single mother of two beautiful toddlers, aged 3 and 4, facing a distressing situation and desperately seeking help. Recently, I received a job promotion that required me to travel out of town a few days every month. Initially, my ex-husband was supportive, but upon returning home from one trip, I discovered an empty house. My husband had vanished, taking our children, belongings, and leaving me in shock. He not only disappeared but also filed for divorce and requested full physical custody of our kids.

To prioritize my children’s well-being and not risk losing them, I made the painful decision to let go of the job I had worked so hard to obtain. As a result, I now find myself in a dire financial situation. I have no income, maxed-out credit cards, and mounting bills. I’m struggling to provide even basic necessities for my kids, and we’re barely scraping by with little food to eat. My life feels like it’s crumbling before my eyes.

Despite my efforts to find online income opportunities, I have had no luck so far. Additionally, my phone line has been suspended, and I recently received an eviction notice. My family members, instead of supporting me, have chosen to mock my predicament. I have nowhere else to turn for help, and the thought of ending up on the streets with my two young children is overwhelming.

In this desperate situation, I humbly request urgent assistance. To catch up on my mounting bills, including rent and utilities, I need approximately $4,500. This sum would alleviate our immediate financial burdens while I continue searching for employment and arranging childcare for my toddlers.

Any support, no matter how small, would be immensely appreciated. I have exhausted all avenues and am left with no viable options. 3 kids and no where to go!!!

Hello my name is Linda I have my 3 grandkids ages 9,5,and 5 months old in my custody. Im almost 63 years old. Disabled. And low income. Being evicted for being behind on rent for 6 months and this is the surcumstances surrounding why it is happening. Our septic tank of our apartment backed up into our basement and I lost our washer and now I have to use the laundry mat. The smell from the raw sewage in our basement was so bad I had to keep the windows open with fans blowing out but the heat on when it was cold. My vehicle died and we live out in the country where there isn’t public transportation. Me and my grandkids have a lot of appointments especially my 9 year old who was sexually abused by her father who needs counciling every week and other mental health needs. So I had to go get a vehicle quick. I got a lawyer for the septic problem so that took money and the landlord went and started eviction proceedings. Their mother is working towards getting them back so I’m trying to keep them out of the system but if we’re evicted that’s where they’ll end up for sure… I’m all they got … all of us have suffered documented illnesses from the septic issue but nothing seems to give. Any help would do wonders for our family. They are amazing kids and I don’t want to see them hurt anymore than they have already been. Thank you.

Now, I aspire to become a beacon for divorced women battling heartbreak and emotional hurdles, teaching them to become emotionally open, in control, and present for their children and their daily lives. However, to transition into this new career, I first need to secure stable housing for my children and myself.

I am in urgent need of $50,000 to cover the past two and a half months’ rent, as well as the security deposit and the first month’s rent for a new place. Desperate Plea for Financial Assistance to Prevent Eviction 7/14/23

Despite my relentless efforts, I have fallen behind on rent payments, and eviction now looms over us.
